“no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.”

This aspect of US law is a point of curiosity by English lawyers who are astonished to learn that expertise in English common law circa 1789 is a “thing” in US appellate law.
