3. It's a double edged sword

On the one hand, fossil fuel companies need to pay for the damage they inflicted, just like cigarette companies did.

On the other hand, enforcement would add dollars per gallon to gasoline and diesel, as well as higher heating bills for natural gas, just like the lawsuits did to cigarettes.

As long as we still get most of our energy from fossil fuels, drastically increasing their cost would be political suicide. But without lawsuits, we won't transition away from fossil fuels fast enough before catastrophic climate change hits us, assuming it isn't already here.
