153. I wish he'd asked Blackwell about the provisional ballot ruling that came
through against the people of Ohio at the 11th hour. Remember provisional ballots were supposed to be counted afterwards, no matter which precinct they had been filled out in, if election officials were able to find that a voter had registered somewhere in the state. I think Ohio's ruling on provisional ballots (Blackwell's nefarious work) was different than in all other states in that it required provisional ballots to be thrown out and discounted, even if the voter's registration was found, if the voter had voted in a precinct that did not match the one they resided in. I thought that was the whole purpose of HAVA adding provisional ballots, to accomodate those that had valid registrations but were for some reason attempting to vote in the wrong precinct. If they were found later, when the provisionals were being counted, not to have been legally registered, then the PV could be tossed. Blackwell was allowed to toss the provisional ballots cast in the wrong precincts even if a valid registration in the state was found for the voter. This was achieved with a last minute sleazoid ruling. If this is a different way of handling PV than the rest of the states, doesn't that make it illegal, since HAVA is a federal law? Is it just me, or is this a glaring irregularity in Ohio?
