Are white people in New York City better drivers?

Now if Gates had installed a home video system to record what transpired, would he have been charged with surreptitiously taping a police officer which is a felony in Massachusetts? (Are people in Massachusetts supposed to ask for permission from the cop first - "Hmmm, officer, can I record you beating me?"
