Ohio Presidential Results to be Challenged

November 20, 2004

Ohio’s 2004 presidential vote will be challenged as soon as next week in the state Supreme Court, a coalition of public-interest lawyers announced Friday.

The lawyers have taken sworn testimony from hundreds of people in hearings in Columbus and Cincinnati, and will use excerpts as well as documents obtained from county election officials and Election Day exit polls to make a case that thousands of votes were incorrectly counted or not counted on Election Day.

“The objective is to get to the truth,” said Columbus Ohio lawyer Cliff Arnebeck, coordinator of the Ohio Honest Elections Campaign. “What’s critically important, whether it’s President Bush or Sen. Kerry, whoever’s been elected actually elected, is to know you won by an honest election. So it’s in the interest of both sides as American citizens to know the truth and have this answered.”

The challenge comes as the Green Party has plans to file for a recount of the state’s 2004 presidential vote. The Green Party and the Ohio Honest Elections Campaign both believe the unofficial results announced on Election Day were wrong. Ohio Secretary of State Ken Blackwell has not yet certified the Nov. 2 vote. The state’s election law says an election challenge must show the wrong candidate was been declared the winner, or it can be dismissed without a hearing. The state Supreme Court’s chief justice hears the case.

The Ohio Republican Party dismissed the challenge on Friday, the Associated Press reported, but the coalition announcing it said they were ready to litigate.

1. I'm not sure that it will really matter...
As much as I wish that it would make a difference, I don't think it will. There has been possible hacking in FL, dems registration cards ripped up in NV and OR. Kerry conceded too soon...

It will just piss off us Ohioans more if we find out Kerry actually won...

What a sad, sad day for democracy.

A crime, once detected and proved, can eventually be dealt with. If nothing else, it would put the apparent neocon momentum to the test.

30. Baron Hill conceded in Indiana - but asked for a recount
when it became clear that Democratic votes were going to the Libertarian candidate.

The concession means nothing.

even if kerry's concession were binding {which it is not} don't you think it would make a whole big lot of difference if the world knew bushit was a crook. how much capitol to spend would he then have if everybody knew he didn't win the election fare and square and was not the legitimate choice of the people in this democracy, using the word democracy loosely. and how long do you think it would take for the people to correct the situation.

4. this is hopeful...but
Does it seem that most of the judges who are supposed to be bi-partisan are appointed by Republicans? Making me think THEY really are partisan. I just hope there are some who aren't corrupt...especially the ones who try this case.

6. I think all (or most) are republican
we just elected supreme court justices here in Ohio and I'm pretty sure all the republicans won. That wouldn't have been so bad years ago, but with the "religious right" and neocons in power, I don't trust any republican politician. As a voter, I've revoked their power! I wish all people would join me in that.

34. In a generous moment, wonder if conservatives are good...
I sometimes toy with the thought that conservatives are good and principled people, if somewhat lacking in imagination when it comes to other perspectives, other people's pain, or history pre 1950. Now, the Rove/Bush/Cheney/Rumsfeld crew are wretched vampires (actually, Rumsfeld's real name is Renfield. Did you see the press conference where he called Cheney "Master" and ate bugs?) Those neocons are the lowest order of scum, and those who vote for them or lie to the UN for them are just misguidedly loyal, perhaps defensive that "their side" is so morally weak and is under attack, and don't understand that their side has been hijacked by bloodsucking inept used car salesmen, antiintellectual ideologues who with every action piss on the core values that conservatives have held for decades, but keep the rhetoric and some window dressing.

The point of this runon sentence? Some Republican judges make decisions based on principle, rather than choosing an outcome and mining the law for some excuse make it happen. So let's hold on to hope that the Ohio Supreme Court will hear the case fairly.
