Kerry Lawyer Asks for Visual Inspection of Some Ohio Ballots

COLUMBUS, Ohio --

"Democrat John Kerry is asking county elections officials to allow his witnesses to visually inspect the 92,000 ballots cast in Ohio in which no vote for president was recorded, a Kerry lawyer said Sunday night.


The request is one of 11 items that Kerry is asking for as part of the recount that Ohio's 88 county boards of election will begin this week, according to a letter sent to the boards over the weekend."

McTigue also asked that counties accept the help of a group called Votewatch to determine which precincts will be chosen for that part of the vote that will be counted by hand. McTigue said using the group will ensure that the ballots are selected using a valid random sampling method."

Why not let these freaking articles see the light of day? By the time any normal person is awake, this will be off the headlines.

I did not care for the tone of the election official quoted in the article one bit. "Mr. McTigue may not dictate the terms of the recount." Not once did he dictate, mostly he asked politely when he should have been DEMANDING.

I want to see these obstuctionists in Ohio arrested, put in the slammer, prosecuted to the fullest extent of the law.

Why is it that only Democrats get arrested in this New America?

The basic procedure for voting in crowded urban polling places sounds like a recipe for chaos and foreseeable miscounting of tens or hundreds of thousands of votes:

"The stage for the mix-ups was set by a state law that requires candidates' names be rotated on ballots so that each candidate gets a turn at the top position. The rotation is done in the name of fair play, a nod to conventional wisdom that undecided voters tend to choose the name at the top.

In Cuyahoga County, where punch-card voting machines are used, the names are rotated on the pages in voting books that guide voters to the proper position on the punch cards. There were five versions of the page for the presidential candidates.

The first version lists the candidates' names alphabetically... In each subsequent version, the candidate at the top of the list moves to the bottom, bumping the rest up one notch. VOTERS FROM MULTIPLE PRECINCTS TYPICALLY SHARE A POLLING PLACE. Candidates' names in voting books are rotated by precinct, so there are different versions at the same polling place.

Voters are supposed to use polling booths, and the voting books in them, that are specific to their precinct, not just any booth in the polling place. The problem comes when a punch-card ballot for one precinct is inserted in the voting device for another precinct. Because of the name rotation, a voter unknowingly punches a hole for the wrong candidate.

17. Uh...are people here thinking the election is gonna be overturned
or something, because that's not gonna happen. Kerry's sort of just going through the motions because he promised everybody that "all the votes would be counted". I dunno, maybe I'm missing the reason people are getting excited about this. It wasn't close enough in Ohio anyhow; it was closer in Pennsylvania, from what I heard. Bush is going to be President for the next four years, unfortunately. It just seems irrational to think otherwise.

elections are fair? And why do we criticize those who see electoral freedom. The voting act etc. The US Constitution. All mean nothing without the proof that our electoral process is not hacked.

I just don't think anything 'big' is going to come out of this. Even if there was some kind of shenanigans that went on, I doubt Kerry or the DNC will push things very far - they would start the 'Sore-Loserman' thing all over again. There would have to be rock solid evidence of something or the American people wouldn't buy it, and it would probably backfire and hurt the democratic party for the future. We'll see though.

35. How much more could the Dem. party be hurt than it is now? Would hurt
a lot more not to make sure every vote counts and that irregularites are investigated to the fullest. Its the American way... and its not about JK and the DNC. It is way past them... thats the beautiful thing.

And JK just has to be supportive... not necessarily lead. Theer are plenty of affidavits, lawsuits, eyewittnesses, mathmatical anomalies to keep this thing going. Factor in the Ukraine factor... The world wants this investigated. This is not going away. b

We are still making noise and I think the message has been a constant one. Since we only have a rumor mill intertwined with frequent updates, links and all the other stuff, I see it growing more each day.

But we're SCATTERED! Cohesion is sorely NEEDED!! I know I've joined more than my share of groups and can hardly keep up with who, what, when and where.

Meanwhile, some DUers are blasting Kerry, some are thinking we need to move to the middle and we have suggestions running rampant. What we don't know, we don't know! Let's give it more time, but let's try to "herd" everything together better. I'm still standing behind Kerry and still not ready to throw in the towel. Let's hang together as DEMOCRATS and support our Party. Even if the Congressmen and Senators don't seem to be doing anything.

It's "We The People!" That's about the hundredth time I've said that!

Kerry's campaign supports the recount but says it won't change the election outcome. Bush's campaign has criticized the recount effort, saying it won't change anything.

Why is Kerry so passive about this thing and why is Bush so afraid of?

My guess is that Kerry's playing the recount down to pacify the Bush attack dogs and keep them out of Ohio. (Remember the mob scene in Florida in 2000?) I'm sure Kerry hasn't forgotten. If he's downplaying the recount because he really believes he lost, then he needs a kick in the pants.

Anyone have figures?

Would there be a difference from state to state?

It would seem like it would be very low since more people are likely to vote ONLY in presidential elections with the express purpose of voting for president.

53. Has anybody noticed that all the refs to ratings on the Yahoo story
show it at 2.93, no matter how many votes there are? When I just checked it was over 1000 votes, at 2.93 rating.

I hate strange coincidences. They make my tinfoil hat warm.

He "asked" to have his folk see the uncounted ballots. It could be grounds for a lawsuit, or buck up their determination. But having his observers count those ballots is not a recount and will not effect the outcome in and of itself. He could have his request turned down (in which case off to court he could go); most likely, they'll say "sure, after the recount, and if you pay for it."

Independent experts have never checked the programing, it's "not allowed." Open and fair elections? How can programing be legitimate without independant experts checking it?

76. Every vote should count!
In a late decision today, the Washington state Supreme Court unanimously rejected a lawsuit from Democrats to review previously rejected ballots in the race for governor. The justices agreed that state law defines recount as only the retabulation of already-approved ballots and does not give any opportunity to review those rejected.

What good does it do to only count the already-approved ballots, the rejected ballots are the ones that can make the difference!
