Appeals Court Refuses to Rehear Cheney Energy Task Force Case

WASHINGTON (AP) - A federal appeals court rebuffed Vice President Dick Cheney, refusing to intervene in a lawsuit delving into the role of business executives and industry lobbyists in formulating the Bush administration's energy plan in 2001.
The administration won only three votes in favor of rehearing the request to step into the case in which Cheney and his energy task force are being ordered to turn over a large number of documents to the conservative group Judicial Watch and the environmental group Sierra Club. The request for a rehearing went to nine appeals court judges.

The rejection Wednesday by the U.S. Court of Appeals for the District of Columbia Circuit leaves the Bush administration two choices.

They must have something pretty serious to hide if they're going to these lengths to prevent disclosure. It's only Energy after all - it's not as if it's military secrets...

and you'll know why they are fighting so desperately to hide the facts surrounding the energy meetings. A report by the Baker Institute of Public Policy submitted to Cheney's task group recommended "military intervention" in Iraq well prior to 9/11 (Sunday Herald, October 6 2002).

The first hijacking was suspected at not later than 8.20am, and the last hijacked aircraft crashed in Pennsylvania at 10.06am. Not a single fighter plane was scrambled to investigate from the US Andrews airforce base, just 10 miles from Washington DC, until after the third plane had hit the Pentagon at 9.38 am. Why not? There were standard FAA intercept procedures for hijacked aircraft before 9/11. Between September 2000 and June 2001 the US military launched fighter aircraft on 67 occasions to chase suspicious aircraft (AP, August 13 2002). It is a US legal requirement that once an aircraft has moved significantly off its flight plan, fighter planes are sent up to investigate.

3. Man, that was my first thought.
How demoralized are we? (OK, it comes and goes)

SCOTUS would be a sure bet but a little obvious. I imagine they can stall in the lower court- reveal in bits and pieces.

But it took nerve for the judge there to stand them down, so who knows?
