FreeRepublic Filing Defamation Suit
Sorry, but there's no actual headline on this AP story.

FRESNO, Calif. (AP) - A Fresno organization called a hate group by a city committee has filed a claim seeking more than $1 million in damages after alleging defamation.

Charles L. Doerksen, an attorney representing the Free Republic, filed the claim Monday after the group says the Human Relations Commission mislabeled them in a news release issued earlier this month.

City spokeswoman Patti Miller said the complaint will be turned over to the city attorney's office.

Doerksen said the news release issued on or around Sept. 12 falsely accused Free Republic members of making "threats of violence toward any minority groups that interfere with their rally or picnic." The group was planning a gathering in Fresno at the time.

Mayor Alan Autry has said there is no evidence that Free Republic is a hate group, adding that the commission is "using the city of Fresno as a tool to attack people without cause."

Can you possibly be MORE offensive? Not that I'm ever going to convince you of anything since you seem to be entrenched in your BIGOTRY but there happens to be a LOT of great people here. We're currently working our ASSES OFF registering voters, making calls and walking precincts against the recall. These are people from "ugly" Peace Fresno and the "ugly" unions and the "ugly" Democrat clubs and committees. You know, the same ones who came out by the hundreds protesting against the war?

The next time you bitch about "ugly Fresno" I might suggest you don't do it with a mouthful of food!

I'm on the other coast, and I have never visited Fresno, but I can tell you this is what _NorCal_D_ meant. You can live in the neatest, sunniest neighborhood in the world, but if your neighbors are a bunch of right-wing jerkoffs, it's still an ugly neighborhood.

The community I live in (Oneida County, NY) is at least as full of conservative whackos as Fresno, so I know what I'm talking about. We also have groups working their asses off making people aware of the ugliness so they can make it go away.

Go ahead and ignore me too, if that will make you feel better.

59. I think that comment was made by one of the council members
That council member was Jerry Duncan. This is the second time this year that he has been questioned on these types of things. He had a personal problem with the head of the Human Relations commision here in Fresno and started with him because he was to dam liberal for his own purpose. Fresno is one of the bastions of conservative crap in this state. Orange county, San Diego and a good portion of the Sna Joaquin Valley are conservative.

By the way, there was a public hearing on this matter at one of the council meetings a few weeks ago, nothing became of it. I guess this is not important enough to address. If the city allows this action to be taken against the human rights commision then it says where they stand, on the side of hate mongers and repugs.

Well maybe after tarring and feathering Flynt the laws against tarring a feathering would be changed to allow for it under extreme circumstances. Never know, could happen. Then think of all the evil people that could be punished for thier legal but evil deeds.

Come to think of it, a better action may be to target Hustler employees. Flynt may be a total scumbag, but he does not run his evil empire by himself.
There has to be secretaries, photographers, computer operators, etc.
Let's get photos of them and make sure their communities know where they work. I don't think their mothers, fathers, in-laws, etc. would be very happy knowing where their son/daughter worked.

but the point here is that political parties and groups can be hate groups. The nazi party was a political party first and foremost. The Dixiecrats were a political party as well. I'm not saying that everyone on freerepublic is a hatemonger but I am saying that to simply dismiss the as "political" is not enough.

I'll pay you the sme compliment. I see your point too. I think we are really arguing semantics here. To me a "hate group" is a group of individuals who encorage others to harass, harm, commit violence upon a group of people because of their skin color, or their religion or their sexual orientation.

And I know what FR did to that waitress in Austin. I also know they got in trouble for it too. Jim Robinison had a lot of tap dancing to do and the info was removed from the site.

What makes this site different (besides our obvious intelligence) is that Skinner et all are real damn strict about what can and can't be posted here. Like the Onion areticle that got FR in trouble yesterday. Would never happen here because mods would remove it immediately.

And they are very careful about posting phone numbers, addresses or calling for a violent overthrow of the government. (Damn, that last rule pisses me off)lol

There isn't any real distinction between highly-charged emotional political expression, be it from the left or the right. We at DU think they are hateful; they a FreeRep think we are hateful. So what? There's plenty anger there; plenty of anger here.

I'd think DU would sue if an official city or state organization classified DU as a hate group. That's different than mere name-calling we find it threads, it's certifiable slander is an actionable.

Just for once people, put the shoe on the other foot. If they can do it to FreeRep, some one else then has a legal precedent to do it to us.

There's a difference between vitriol and self-incriminating reports of criminal activity. I've seen post after post at FR where they recount acts of vandalism, intimidation, stalking, fraud, etc... They may scrub the threads, but some of us have saved the choicest posts just waiting for an oppurtunity like this.

I've personally called federal and state law enforcement agencies on FR in the past. Any lawyer worth his salt will be able to find reems of complaints that have been made against those throw-backs.

If you think DU is as vulnerable as FR on these points, you're on crack.

On the rare occasion I've seen a post here that actually calls for violence or some illegal act, it has immediately been pounced on by all members, alerted, and immediately removed by the moderators. This board DOES draw the line. The above long thread about Larry Flint wouldn't have lasted five minutes here. So, you are wrong.

However, the court may require the council from referring to them as a hate group in the future. Could even order an apology. But they won't get a dime in money damages....it hasn't damaged them. They have done that to themselves.

Assuming CA law is applied, I suspect their postings regarding the above groups would satisfy as hate speech, particularly the volume of hateful posts on those topics.

How have they been damaged in the amount of $1 million? That could be tough to prove, in part because they are a nonprofit that operates on donations.

First of all, they'd have to have character to defame, not to mention show that being called a 'hate group' constituted defamation. If they did, indeed, make threats of violence based on race or religion (which is quite compatible with what many freepers post), then they have shown themselves to be a hate group.

A section discussing FreeRepublic and their hateful ways. Specifically, he detailed the situation here in Austin with the Chuy's restaurant manager who called the cops on the baby Bushes when they were passing phony IDs to buy booze. The freepers called for her to be terrorized, gave out her vital statistics online (including that she had an infant), and encouraged people to teach her a lesson. She was understandably terrified.

Some of those folks may be OK, but by and large I consider them dangerously narrow-minded and fearful, making them prone to resolving conflicts with violence or inciting others to violence while they hide behind the anonymity of their computer screens. These are not nice people. Or, as our illustrious leader said about the British citizens held at Gitmo: "We're talking about bad people."

A forum is the totality of the posters of that forum. If a significant percentage of posters engage in classic "hate group"-type behavior - as we'd probably all concede that the majority of FR posters do - then it's a hate group. I don't have a problem with saying it, so I don't have a problem with someone else saying that - in the government or not.

Of course, I obviously do have a problem with any attempt to even hint at curtailing their speech, but the above action doesn't come close to that.

that DU and FR are equal. They are not! You cannot make that judgment based on the number of times the word "hate" is used. Are you being purposefully ignorant on what the definition of a hate group is. Using the word hate does not make a person of a hate group. Freepers promote hatred of a group(s) and advocate attacking and harming individuals based on their belonging to a certain group. If these actions are carried out, they constitute a hate crime.

There is a HUGE difference between what they do and what takes place here. Since you have made the assertion that we are the same, I challenge you to prove it.
You find me threads that have been posted here that are on the same par with the ones that have been provided in this thread from the Freeper site.

I'm not talking a comment or two out of context. I'm talking about a consistent pattern hatred, threats, condoning violence and harassment that takes place there on a daily basis. What I have noticed is that when a poster comes up with something particularly hateful, the group here immediately pounces and calls them on it and denounces it. Over there, they encourage hate and revel in it.

On a live thread for people watching the Miss America pageant, several people were complaining about the "non-white" contestants winning out of proportion to their representation in the population.

For some, this year's winner, Miss Florida, was the last straw. It got so bad that even some of the regulars were apologizing.

No doubt her lawyer has a good idea - and is wise enough to play his cards close to the vest. I know that I wouldn't care to speculate as to a defense, since I wouldn't want to take any risk (no matter how small) of tipping off the prosecution.

The important thing is to get Jenna off, and then destroy Mia. Make her life pure, unmitigated, endless Hell. Break her...all quite legally, of course. No bill which he sponsors should ever get out of committee. He should be spoken of only in the third person, as if he were not there!

73. Please allow some clarification from an "ugly" person living and
working her ass off for progressive causes in "ugly" Fresno.

First off, let's just agree that Jerry Duncan is an asshole who has made several extremely offensive off-the-cuff comments in e-mails and verbally. We're working on finding a more centrist Democrat to run for his seat next year.

Now, for a brief explanation of the surrounding events:

The Human Rights Commission was established several years ago and has worked peacefully, and successfully until ONE fairly new member, who is the sister of a State Senator who believes that being a relative of said State Senator giver HER power. I've got some background on this individual, including racist comments made from her to me -- which I let go, but *I* can't afford to be sued so I won't get into detail.

Anyway, she spotted the picnic put on by Free Republic here locally and, without authority from the rest of the commission and without prior knowledge, sent out, ON CITY STATIONARY, the "hate group" letter. That's when she got her ass in a sling.

Needless to say Jerry Duncan and Mayor Bubba, er, Autry, and their pod-people followers were calling for the abolition of the ENTIRE Commission -- how conVENient of her to hand them that little jewel. For the moment, the fires have been quelched but I won't be surprised if, by her incessant grandstanding, she puts the Commission in jeapardy again.

In summary, NEITHER side is right and BOTH are polarizing factions.

Fortunately, clearer heads will prevail, and most will realize there are bigger fish to fry.
