WP: New Tack Against Illegal Immigrants: Trespassing Charges
http://www.washingtonpost.com/wp-dyn/content/article/2005/06/09/AR2005060902035_pf.html

The police chief of this tiny whitewashed New England town has crafted his own border-control policy -- he has charged illegal immigrants from Mexico with trespassing in New Hampshire.

The novel legal strategy has made a minor celebrity of W. Garrett Chamberlain. The 36-year-old police chief hops to his feet and deposits a pile of letters on his desk, from Alaskans and Californians, Border Patrol agents and soldiers in Iraq, all applauding his initiative. Fox News commentators have called, too, seeking his views on national immigration policy.

Chamberlain, who has served as chief for three years, describes his actions as born of frustration with the federal government. His officers had discovered illegal immigrants several times, but immigration agents declined to detain them.

"I'm just saying: 'Wait a minute. We're on heightened alert and it's post-9/11, and I'm going to let an illegal immigrant who I don't know from Adam just walk away?' " Chamberlain said. "That's ridiculous. If I find you are in my country illegally, I'm not going to worry about political correctness. I will detain you."

1. Seems like jail space would fill up a bit too quick.
However feds won't prosecute employers and won't watch borders, so this is at least a deterrent. Good for him. Now I better stop drop and roll.

2. Anyone realize that these are the descendent's of the former owners...
...of this land being detained by the descendent's of wealthy landowners who stole this land from the Mexicans to begin with? And what is this detain shit anyway? That sounds like a recipe for disaster. Trying to detain a person is one step away from someone getting hurt or killed if the person does not want to be detained. These crazy bastards.

3. Mexicans with descendents from New Hampshire? Probably not.
Edited on Fri Jun-10-05 01:59 AM by Joj Bush
And if the illegal immigrant happens to be the type of person who would try to hurt or kill a policeman, then they should indeed be in jail. Though I don't see why they'd be more likely to do that than anyone else being arrested.

10. Western US
We paid them $10 million for TX, AZ, NM, & CA. Fought a war, remember? The treaty signed is part of the reason Mexicans have more rights than people of other countries, we granted them the right to their culture, language, etc.

6. Yes, but what do that have to do with the original poster's claim
that this land (america) belongs to the mexicans?

7. What about em?
Edited on Fri Jun-10-05 02:36 AM by Joj Bush
The various Native American nations had people as different from each other as French people and, say, Russian people, and it doesn't make too much sense to say any given Mexican immigrant to New Hampshire, who could have Spanish ancestors for all we know or most likely has ancestors only from Mexico or further South, used to own that land. I'm part Native American and I still don't agree with that argument. Secondly, they're not coming here because they want more land.

If instead of our policy of greedy immigrant labor exploitation we gave serious aid to Mexico, it'd be better for America and Mexico. The ways things are now it's bad for Americans, and may be good or bad for the immigrant.

8. I'm getting confused.
I was replying to the NN001? poster who wrote that whites stole this land (presumably the U.S.) from the Mexicans - if I understood that correctly. I'm so confused as to why someone would write that New Hampshire was Mexican territory - that's such an outlandish stretch that I'm confused by it now.

I was pointing out that everyone with some European ancestry stole North America from the Native peoples who were here when the whites showed up. I never hear anyone talk about the tribes of the Southwest when the old argument starts between who has the right to claim AZ,So. CA, NM, TX.

Every country has to control it's borders. I want to illegally immigrate to Europe but I know I'll get deported back here in 2 shakes of a lamb's tail if I don't apply and go through their legal channels. They don't want me coming over and taking an EU citizen's job. I don't understand how or why it should be different in the U.S.

9. Ah I see
I thought you might be making some equally outlandish argument to agree with NN001, I should've interpreted it in the way that makes sense. I agree with you.

11. Fine the employers who hire these people who are here illegally.
That's the first step. One thousand per hour ($1000.00) per illegal would be a good start.

15. If you really want to hurt them pay the fines directly to the illegals...
then we'll see if americans still "won't" do jobs illegals do.

13. No more Quebecois to kick around?
New Hampshire is a border state, but it's a different border.

New Hampshire has come late to wrestling with immigration. While French Canadians once poured in to work in lumber and textile mills, the state's modern growth has been fed predominantly by white residents moving north from Massachusetts. They have often settled in towns where historically much stock was placed on fitting in.

"One has to recognize that a lot of people coming from Massachusetts are to some extent trying to leave behind the issues of immigration and ethnicity," said Prof. David H. Watters, director of the Center for New England Culture at the University of New Hampshire. "There is also an old tradition in New Hampshire of 'warning' people who were not born there out of towns. That sensibility still survives."

The police chief needs to come down on the people who are doing the hiring. But they are probably tight-fisted Yankees who "fit in."

Note: I was actually born in New Hampshire, although I've been a Texan most of my life.

20. problem with the primordial ooze theory
is there was only one law back then ...the law of Nature

Nowadays ...after much of that primordial ooze has returned back to the dirtball in the form of shed blood.

Nations were set up. Right or wrong, most... at the expense of a losing tribe, some... at the benefit($compensation)of a losing tribe. The Nation is the extension of the winning tribe. Where like members of the tribe congregate to pass laws. Some out of fear, Some out of the natural instinct for protection. Because, witnessing the blood that returned to the dirtball, none are under the illusion the dirtball is safe place to be. They are also under the realization that there is always a bigger tribe out there... lurking , waiting to destroy what they; their father; their fathers, father; their fathers, fathers, father; struggled and strained to build up in wealth and values. Most usually are so large , an elder is needed to represent large blocks of tribal members with differing needs.

If it were set up so that under a supertribe(In reality ,just a tiny group of usurpers), no tribe could make laws that protected their tribe from incursions by members of a foreign tribe , then the tribe would in effect be forfeiting it's power to a Supertribe that dictates from one place. So, no matter which way you slice it, it's still a tribe.

So, the supertribe is the logical endgame...or so we are told. But don't ever fool yourselves into thinking that it won't mean forfeiting your ancestor's hard work and conquest. It always happens when there is a change of tribes.

22. any nation has the authority to police its borders...
... and to decide whether and under what conditions noncitizens may enter the country. America is no different in this respect.

And this police chief has both the authority and the duty to enforce state law.

We have every right to refuse entry to newcomers if we don't want them. We aren't wronging anyone if we decline to open our borders to everybody in the world who feels like moving in.
