Rush Limbaugh wants to review medical records before investigators
By JILL BARTON
Associated Press
Posted June 15 2005, 1:06 PM EDT

WEST PALM BEACH -- Rush Limbaugh's attorney asked a judge Wednesday for copies of the conservative commentator's sealed medical records so he can provide a list of privileged information that should not be turned over to prosecutors investigating Limbaugh's drug use.

The state attorney's office says the records contain information that Limbaugh illegally purchased prescription painkillers and engaged in ``doctor shopping,'' or illegally deceiving multiple doctors to receive overlapping prescriptions.

Investigators seized the records with search warrants in 2003 but they have remained sealed because Limbaugh appealed, arguing that the case threatens the privacy rights of all Floridians. He lost at the Circuit and appellate court levels, and the Florida Supreme Court declined to hear the case. But his appeals successfully stalled the investigation for more than 18 months.

Limbaugh now wants to review the records before investigators and wants to develop a log of those that would be relevant to the criminal investigation, said his attorney, Roy Black.

gee Rush, why in the world would you want to see those records before the investigator?

Do you want to formulate a pre-emptive spin script?

what likely diseases/treatments would a (publicly) homophobic, (publicly) family values oriented, drug addicted, overweight, sedentary, middle-aged male have that would lessen his credibility to his homophobic, family values oriented, drug addicted, overweight, sedentary, middle-aged male listenrs?

I like how Rush thinks he should review the records and he can decide what is "relevant." After he appealed his case to the US Supreme court claiming none of it is relevant. LOSER!!!

29. One very special thing a defense attorney will do is try to delay the

trial as long as possible. The longer it is before one actually goes to trial, the better for the accused. It appears by trying to get it put off as long as possible actually helps the defense because over time, jurors as well as the public view tends to settle down a lot and tensions are eased.

He has been very successful since it has been 18 months.

Also, it is evident he is guilty just on the fact that he went deaf. Abusing opiates and barbiturates will cause deafness. This man was allegedly taking 30 OxyContin in one day.

Does anyone remember when he would even sit on his show and say that the liberal-based radio stations were slurring his voice on purpose to make him sound illiterate (of course, this was before he was caught). Sure, it was the liberals doing it alright. Couldn't have been you taking over 500 OxyContins a month, huh Limpballs?

Oh, also, they help you lose weight too. Remember he lost hundreds or a hundred pounds as well? Is he putting it back on?

14. I think the procesutor needs to use discretion when let out information
about Rush's medical record--in the sence that the only information that is relavant is information relating to the criminal charge of doctor shopping. This applies to Rush or any of us.

13. I don't believe he can audit the records before
the state attorney's but I do think that discovery issues come into play somewhere in the course. I don't know why he can't get copies of his own medical records at this time like anyone else ...unless, it's evidence and the originals have been secured.

What are the details?

15. The penile implant the breast reduction operation, it's sordid
Rush would like to keep these things private. Also, there's the sensitizing nipple cream prescription, the pharmaceutical masturbation lubrication script, the medically-prescribed penis pump (specially imported from Asia for men with exceptionally tiny dongs), the custom-fitted medicated hemharroidal thong, the liposuction scar topical ointment, the semen production stimulant, the Cialis, the Viagra, the Levitra, the Rogaine, the Rogaine, and don't forget the Rogaine.

We should give the man some privacy, don't you think?

Not.

16. This is a criminal case, not a civil case
You don't get a chance to redact discovery of the evidence against yourself. Besides, Rush, can't you just request your own medical records from your own doctors? Nothing prevents you from doing that, you know.

Can't imagine what he would want to hide, because as we all know, if you've done nothing wrong, there's nothing to hide. And Rushbo would never e-e-e-e-ever do something wrong, would he?

30. I worked in medical records for a long, long time and no one,
not even a judge gets the original record. They can get as many copies as they need; however, the original is the property of the hospitals/doctor's office.

So they can get a whole copy, and if they change anything, the prosecuting attorney can get another court order to get a copy of his records again.

The originals are kept on file. If the patient has not returned (I believe) in 2 years, the records are then copied onto microfilm. The microfilm is stored at the hospital and the paper records are removed and put in some warehouses somewhere in Arizona. Over time, the microfilm follows. Everyone that has ever had a medical record but is dead now still has their medical records in some big ass warehouse.

A person will tell their doctor things they will not discuss with anyone else (sometimes, not even their spouse or family). A Persons Medical records tells everything about them from the time they are born until they die. That is very valuable information and can be used against people.

Big Brother, HA!
