WASHINGTON -- Sen. John Ensign on Thursday renewed an effort that began more than a decade ago to remove Nevada and some other Western states from the jurisdiction of a federal appeals court that has been criticized as being too liberal.
The 9th U.S. Circuit Court of Appeals, which is based in San Francisco, would no longer rule on cases from Nevada, Arizona, Idaho and Montana, according to a bill introduced by Ensign, R-Nev.
Ensign's bill would create a 12th U.S. Circuit Court of Appeals to review cases from Nevada and the other three states. Ensign denied his legislation is politically motivated.
"I don't even have to go down that road," he said. "Just look at the size of the 9th Circuit and how it compares to other circuits. It has become unwieldy, and the decisions from that court are not as thoughtful and independent as in other circuits."
But Ensign also said the opinions of the 9th Circuit "are not consistent with the views of most Nevadans."
