Judge dismisses slander claim against filmmaker Michael Moore

JoANNE VIVIANO
Associated Press
----------------------
DETROIT - A federal judge in Detroit has thrown out a libel and defamation lawsuit filed against filmmaker Michael Moore by the brother of Oklahoma City bombing conspirator Terry Nichols.

U.S. District Court Judge Paul D. Borman ruled Wednesday that statements Moore made about James Nichols in the 2002 "Bowling for Columbine" documentary were "factual and substantially true."

James Nichols of Sanilac County claimed in the suit that the statements could be misinterpreted by viewers to inaccurately link him to the bombing. He also claimed the film invaded his privacy and inflicted emotional distress.

(snip)

Among statements James Nichols took issue with were those alleging that federal prosecutors formally linked the Nichols brothers to McVeigh, that the brothers made "practice bombs" before Oklahoma City, that both were arrested in connection to the bombing and that they both were charged with conspiring to make and possess small bombs. Also at issue was a statement that the feds "didn't have the goods on James," so charges were dropped.

1. Invaded his privacy?
Edited on Thu Jul-14-05 11:36 AM by XanaDUer
How? He invited him in his home, it seems.

And wanted to show him his big gun under the bed or wherever it was.

Funny how these people hate frivolous lawsuits and guvmint intervention, but have no problems using them to their own advantage.

2. James Nichols is a lunatic who was probably in on the OKC plot
During the whole thing, we in Michigan had to watch that idiot on the local news for months ranting about the government and plots to get him. He came across as nuts in Moore's movie because he is nuts.

3. Unless you're a progressive liberal and Moore agrees with you...
you've gotta be nuts to speak to Michael Moore in the first place.

When Michael Moore (or someone from The Daily Show) appears at your doorstep, it's generally not a good idea to speak to them.

With that said, I'm very glad that so many people don't understand that.

7. It's buyers remorse for egotistical idiots...

Of course people shouldn't do these interviews, but when someone sticks a camera in your face and tells you you're going to be on TV (or better yet, in the movies), most people still become irrational babbling idiots, like it's the 1950's and getting your face on television equals instant celebrity.

Do you watch the new Family Guy episodes? In a recent one, a man in a huge orange afro wig walks up and randomly kicks Peter in the balls. Peter and Lois start screaming that the guys a lunatic until he points out that they're on a reality television show called "Kicked In The Nuts". Suddenly they're excited and happy and even shake hands with the guy.

The show (while staged) is real.

4. Neocons seem to think that Moore spouts lies. EVERYTHING he puts in his
documentaries are factually backed up and he does quote the sources that they came from.

That's more than you can say for Faux news

5. Great!!! Now let's confine James Nichols...
to the dustbin of history, although every time we watch "Columbine" we'll be reminded again

8. This guy's crazier than a soup sandwich
I'm sorry, but any damage done to James Nichols via this documentary was entirely self-inflicted. He quite obviously belongs in a sanitarium, and I for one hope that he gets the help he needs.
