Judge denies bond for Cuban militant, seeks Bay of Pigs opinion

A federal immigration judge asked lawyers involved in the deportation case of a Cuban militant Monday to provide briefs on whether the Bay of Pigs invasion could be considered an act of terrorism. Judge William A. Abbott also denied bond for Luis Posada Carriles, 77, a former CIA operative accused of orchestrating the 1976 bombing of a Cuban jetliner while in Caracas, Venezuela.

Posada has been held in an El Paso federal detention center since May on charges that he sneaked illegally into the United States through Mexico and is seeking asylum in the U.S.

Recently declassified CIA documents show that the spy agency trained Posada in Guatemala in 1961 to participate in the failed Bay of Pigs invasion of Cuba, including explosives and weapons training. Posada, who rose to the rank of second lieutenant, was in the U.S. Army from March 1963 to March 1964 in Fort Benning, Ga.

According to a declassified CIA document released last month, Posada said shortly before the deadly bombing that he and others would "hit a Cuban airplane." Venezuelan officials have said Posada was in Caracas when he allegedly planned the attack, which killed 73 people when the plane crashed off the coast of Barbados.

Bay of Pigs case may drag in CIA

A US immigration judge has denied bail for an asylum-seeking former CIA operative from Cuba and asked for legal briefs on whether his role in the 1961 Bay of Pigs invasion was a terrorist act.

Lawyers for Luis Posada Carriles called the request "surprising" because they said if Mr Posada were found to have engaged in terrorism, it would imply the CIA did also.

The CIA backed the ill-fated attempt by 1300 Cuban exiles, armed with US weapons, to topple Cuban leader Fidel Castro after landing at the bay on Cuba's southern coast.

Mr Posada, 77, has admitted working against Castro and earlier said he was involved in the Bay of Pigs operation, but his lawyers said he was not in the actual invasion.

EL PASO, Texas (AP) - A federal immigration judge on Monday denied bond for a 77-year-old Cuban militant accused of orchestrating the 1976 bombing of a Cuban jetliner.

Luis Posada Carriles, 77, has been held in an El Paso detention center since March on charges he sneaked illegally into the United States through Mexico. He is seeking asylum in the U.S.

Posada's arrest strained relations between the United States and several Latin American and Caribbean countries. Those governments want the Bush administration to deport Posada to Venezuela to stand trial on the airplane-bombing charges.

Among the factors Judge William A. Abbott said he would consider in Posada's case was whether he had ever provided material support for acts of terror.
