Panel Sends Judge 10-Page Questionnaire

WASHINGTON, July 27 - The Senate Judiciary Committee sent a 10-page questionnaire to Judge John G. Roberts on Wednesday that could yield new details about his behind-the-scenes role in the Supreme Court case of Bush v. Gore, the Florida recount battle that decided the 2000 presidential election in favor of George W. Bush.
The bipartisan questionnaire, which is similar to previous surveys submitted to candidates for the Supreme Court, asks Judge Roberts to list all memberships in and any "services rendered" to any political party or election committee. It also seeks "any memoranda analyzing issues of law or public policy that you wrote on behalf of or in connection with a presidential transition team."...

After President Bush announced last week that he had selected Judge Roberts to fill the vacancy created by the retirement of Justice Sandra Day O'Connor, a spokesman for Gov. Jeb Bush of Florida said Mr. Roberts had provided the governor quiet legal advice during the recount, though he would not say what sort of advice....

Mr. Roberts edited legal briefs produced each day by the Bush team of 400 lawyers as the case was moving through the lower courts. And he played a crucial role in editing the final 50-page Supreme Court argument, prepared in just 24 hours. He also prepared moot court questions for Mr. Olson and participated in a dress rehearsal in preparation of Mr. Olson's arguments before the court, Mr. Cruz said.
People involved in preparing the Judiciary Committee questionnaire discussed it on the condition that they and their political parties not be identified. They said that depending on how the questions on political activities and affiliations are interpreted, it was possible that the survey would not yield any new information about the judge's role in the Florida case....
