Roberts Assures Dem He Won't Be Activist

Associated Press Writer

WASHINGTON (AP) - Supreme Court nominee John Roberts gave assurances he wouldn't be an activist if confirmed, a key Democrat who already was leaning toward supporting him said Thursday.

``I don't see anything that's going to be disturbing'' in his record, Sen. Ben Nelson told reporters after a 30-minute meeting with President Bush's choice to succeed Sandra Day O'Connor on the high court.

Democrats have been pushing to review as many of Roberts' writings as possible, hoping to gain a better understanding of his personal views and the extent to which he might seek to inject them into his judicial rulings.

``He said he would not be an activist judge,'' Nelson said.

As a member of the Federalist Society and a "strict constructionist",the Roe Court was an activist court which created a privacy right not present in the Constitution. His statement that Roe was "the law of the land" is similarly misleading since it was made in the context of his nomination hearing for an appellate seat which would require him to follow SC pronouncements. Not so if he were on the SC as he could vote to overrule that decision.

What the fuck does it matter?

Roberts will probably toss the religious right a bone on abortion by passing it off to the States or some other concoted BS but he won't overturn their mainstay issue for no reason.

The real "downside" is hes going to do exactly what SCOTUS has been doing for longer than I've been alive: screw the living shit out of us when it comes to economic rulings. Its not as though this guy is in the pocket of big business or anything..is it?
