Legislation Authorizing Civilian Border Patrols Introduced
Aug 2 - As Congress readied to head home for the summer recess, a Texas Republican introduced a bill that would put the controversial Minuteman group and other civilian-led efforts to enforce immigration laws officially under the aegis of state executives.

Last Thursday, Representative John Culberson and 47 other legislators introduced the Border Protection Patrol Act, H.R.3622. The measure would give governors of states bordering Canada or Mexico the power to officially deputize groups of citizens to hunt down people immigrating illegally.

Collectively, the groups would form the Border Protection Corps, and would be empowered to "use any means and any force authorized by State law to prevent individuals from unlawfully entering the United States," according to the language of the bill. Each state’s Corps would be under control of the governor, who, under the proposed legislation, would be "authorized to call United States citizens into service in the militia."

Two weeks ago, Customs and Border Protection Commissioner Robert C. Bonner floated the idea of designating anti-immigrant vigilante groups an "auxiliary" arm of the Border Patrol, an idea immediately denied by the Department of Homeland Security.

Canadian sentenced for trying to smuggle 14 people into US

Coeur d'Alene, Idaho — A Canadian citizen has been sentenced to time served -- four months -- for attempting to smuggle 14 people into the United States, apparently to work in a California prostitution ring.

Sang Yoon “Steven” Kim, 29, of Surrey, B.C., pleaded guilty in May to one count of transportation of illegal aliens. He admitted to smuggling 13 South Korean women and one man across the Canadian border into Idaho.

Federal prosecutors recommended a lenient sentence because Mr. Kim co-operated with investigators.

At sentencing Monday, U.S. District Judge Edward Lodge gave Mr. Kim credit for the four months he's spent in jail since his arrest, and ordered him to be turned over to immigration officials for deportation proceedings.

One of the joys of the Patriot Act is its emhasis on recruiting any Tom Hairy Dick to enforce immigration law, including grocery store security guards, campus police, small town sheriffs, anybody. The section of law cited as authorizing this is a section of the Immigration and Nationality Act that says that, under extraordinary circumstances, with specific training and under close supervision, for specific purposes, the assistance of local law enforcement officials may be enlisted in support of immigration enforcement activities. That has morphed into anybody who wants to swing a baseball bat at a brown-skinned person should feel free to do so. And the consequence is a great many illegal detentions of people who have done nothing wrong and in many cases are actually US citizens, by enforcement officers lacking any training or supervision and who wouldn't know an illegal immigrant of one walked up and bit them on the ass. There have been a number of reported cases of US citizens being summarily deported to Mexico, whose government officials are understandably somewhat puzzled, since the deportees aren't citizens of Mexico but of the US.

This isn't what this vigilante law is proposing at all. It's dangerous to say it is, you have heard of the boy and the wolf. Cry wolf too often, and nobody will believe you when the wolf is really unleashed.

so why is this bill needed?

TITLE 10 > Subtitle A > PART I > CHAPTER 13 > § 311 Militia: composition and classes

(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b) The classes of the militia are—
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.
UNQUOTE

Moreover states have some form of “unorganized militia”, many of which are members of the The State Guard Association of the United States.

It looks like Congress has not done its duty under the Constitution to “To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress”. That responsibility includes the “unorganized militia”.

US citizenry just be a necessary nuiscance to them - 'specially for the tax dollars the PNACers glean offa the poor for their WarMachine and their Korprate buddies . . .

What is their major malfunction? Uh, you get more border patrol.

The TX scene is already strange. A key leader just quite because they were racist. We'll just have a bunch of 'brown shirts' who will terrorize all of us, not just those trying to get in.

They would NOT cooperate with these state-based groups. At least the Minutemen were officially "watching"--these guys would be authorized to "use any means and any force." What a stupid idea--there would be legal ojections from all sides. Sounds like Culberson is grandstanding for the constituents. Gosh, he appeared on CNN last night to discuss his brilliant idea: www.culberson.house.gov/default.aspx

Culberson represents District 7 in Houston. No doubt he's gone door-to-door in West University Place, Bellaire & "The Villages" to ensure all the household help have green cards. Here's a site that links Culberson & DeLay--warning, it's a "partisan" site--how dare they say bad things about DeLay? (Culberson's district was affected by the recent redistricting.)

well almost, - it may not be legislated in, but it will happen,

just like many other operations that the PNACers have been carrying out for decades that do not exist . . .

It's taking a wee bit of time, but it is slowly being revealed to the world that the United States of America is not really "united", and is certainly not the beacon of democracy and freedom they preach to be

They are a WarMachine - plain and simple - if the Middle East had no oil - the YouKnighted Staytes of Amurikkka wouldn't be there

and a WarMachine such as the USA"s needs oil more than anything - well, 'cept for willing yungun's to be cannon fodder, and there seems to be a dwindling supply of them too - so need more remote weapons (ergo "star wars")

I desperately hope I am totally wrong . .

but I fear I am right
