Journey for justice ( Maui Kamehameha Schools)

KAHULUI – A Native Hawaiian originally from Molokai, 58-year-old Olga Kepa said she had never seen such a large crowd of Hawaiians gather as the one she saw at the Kahului rally in support of Kamehameha Schools.

“This is the biggest crowd I’ve ever seen,” Kepa said.

Now a Wailuku resident, Kepa was among an estimated 2,000 people who came together in prayer and in protest of a federal court ruling that struck down the Kamehameha Schools’ policy of giving admissions preference to Native Hawaiians.

“We are on an arduous journey for justice,” Kamehameha Schools Maui Headmaster Rod Chamberlain said at the onset of the rally held Saturday on the lawn of Maui Community College.

2. Can someone explain to me the legal difference between this school
and a private "country club" that requires one must be WASP male to join?

I understand the differences in intent, but not in principle.

5. I did.
And I've read a few articles about the subject over the past few days.

I understand the rationale behind the school and their admissions policy, but by letter of law it still seems like discrimination.

But when we strip this case down to the basics, I don't see it as much different than a private country club saying that they only allow WASP men in their membership, but if they don't meet their quota of new members for that year, they may consider other applicants.

10. you didn't explain how it fails to violate
the Civil Rights Act. Can you do that? Legally? $5 says you can't. Private educational institutions cannot discriminate based on race. Even traditionally black colleges admit whites, if they're qualified.

that question, very well.

in Hawai'i, people of every ethnicity recognize there is a difference, except the mother of that one student.

hopefully that difference will be successfully argued on appeal.

i can not state those issues adequately, but those linked articles very much clarify them.

6. Anybody notice any similarities to the Akaka Bill?

Has anyone noticed any similarities between this and the recent passage of the Akaka Bill? I think this is the federal government trying to get it's hands on the Bishop trust and Bishop estates which has huge land holdings in the islands. The timing of this with the Akaka bill tells me at least that much.

between pre- and post-western contact - that is, pre- and post-illegal overthrow by the west - it would serve that purpose. but it seems more broadly threatening than that.

since the u.s. was just beginning to correct some slightest bit of the immeasuarble devastation it's done Kanaka Maoli (native hawai'ians) and ka 'aina - the precious land....

Bottom line is this. Since our government dose not recognize Hawaiians like native Americans, Kamehameha falls under American law which prohibits descrimination based on race. Kamehameha Schools must adhere to federal civil rights statutes, and the judges ruled that its admissions policy is illegal because they operate “as an absolute bar to admission of those of the nonpreferred race.”

Without self determination as an indigenous people they are just Americans … no more… no less. The “Akaka” bill for Hawaiian recognition has been stalled in the senate again and has been for years. The repukes keep blocking it.

is the difference between the genocide we committed on Native Americans, and the genocide we committed on Hawaiians? I see no difference, myself. The law does not always serve justice.

17. What does genocide have to do with it?
Bottom line - the admission policy discriminates against non-Hawaiians. US law says that is illegal. And yes, you are right, the law does not always serve justice.

"Ron Natividad, a Native Hawaiian, said he normally doesn’t attend public rallies. He made an exception Saturday, even rolling out a handmade sign that featured a brown mat spray-painted with the message: “Respect the Legacy.”

That says it all..how would a kid feel who had to go to court to get into a school where the originator designated it for Hawaiian children?
