Trespassing Dismissed Against Immigrants

By ANNE SAUNDERS
The Associated Press
Friday, August 12, 2005; 4:45 PM

CONCORD, N.H. -- A judge on Friday dismissed trespassing charges
against a group of illegal immigrants arrested by two small-town
police chiefs who said they were frustrated by lax federal enforcement.

Judge L. Phillips Runyon III agreed with defense lawyers that the
police chiefs in New Ipswich and Hudson had violated the Constitution
by trying to enforce federal laws.

Law enforcement officers from around the country praised the local
police chiefs for their novel approach to homeland security.

The immigrants, most of whom were from Mexico, were cited with
trespassing after being stopped this spring on traffic violations and
then admitting they were in the United States illegally, police said.

1. How can they trespass
in their own country?

2. This isn't their own country.
They are from Mexico. Mexico is "their own country". Just because they came here does not make this their country.

3. trespassing deals with private property, which the town of New Ipswich
obviously is not. If they wanted to charge them with something else it's a different story, but trespassing is just stupid.

4. harassment
plain and simple. You are not trespassing by walking through a public space not matter what state you were born in or what your immigration status is.

5. It's just me, I guess.. (big surprise!)
but I tend to disagree. New Ipswitch is the property of the United States. If you are here illegally, you are trespassing in my country.

6. nope

Look at it this way: if New Hampshire can start deciding who is here legally or otherwise, why can it not start writing its own immigration rules? Do you see the problem?
