Legal Experts: Rove Testimony a Risky Move

WASHINGTON - Presidential aide Karl Rove's upcoming fourth appearance before a federal grand jury investigating the leak of a CIA officer's identity is a risky legal move because it opens him up to making statements that are inconsistent with what he previously has said, legal experts say.

"In a normal criminal investigation, most defense lawyers are extremely cautious about their clients testifying even once before a grand jury and are generally loathe to let them testify more than once," said former federal prosecutor E. Lawrence Barcella Jr. "This is a classic example of what happens when there's a large political overlay to a criminal investigation."

Stephen Gillers, a New York University law professor, said it was unusual for a witness to be called back to a grand jury four times and that the prosecutor's legally required warning to Rove before this next appearance is "an ominous sign" for the presidential adviser.

"It suggests Fitzgerald has learned new information that is tightening the noose," Gillers said.

3. I get the idea that Rove is actually focus grouping on this
and coming to a grand jury and thinking he can spin his way out of it.

He is no "genius" he never was he simply takes advantage of a lapdog media.

5. What does this bit mean?

The last I heard, Karl's lawyer said that Karl had not received any letter from Fitz and that he (the lawyer) felt that was a good sign. Have I missed something, or is the spin going on?

...last night on Olbermann, a legal expert said that rove's lawyer was surely parsing his words. You can see it here.

13. He's Parsing Words VERY Narrowly
If Rove's a target, it's not necessary for him to receive a letter, especially since he's already appeared before the GJ.

Fitz could have verbally informed him he was a target, or sent the letter to his lawyer, etc. It was not a denial that Rove was a target, which is interesting because in the past they HAVE made that denial, IOW, they've said "Rove has not been identified as a target". Now they are saying "Rove did not receive a target letter". This actually tells me Rove IS a target and they are just parsing words.
