WASHINGTON (AP) - The U.S. Supreme Court on Wednesday heard arguments about whether two miners may sue federal officials for negligence following an accident in an Arizona copper mine that left them paralyzed.
Joseph Olson and Javier Vargas were seriously injured in 2000 when a nine-ton rock slab fell from the ceiling of the Mission Underground Mine. They allege that the Mine Safety and Health Administration was negligent in its inspection of the mine and that inspectors knew about complaints of problems, including a lack of adequate bolts on the roof to prevent rock falls.
At issue is whether the federal officials can be sued under the Federal Tort Claims Act, a law designed to waive government immunity and allow people injured by a federal employee to recover damages.
