BlackBerry Maker Denied High Court Appeal
WASHINGTON (AP) -- The maker of BlackBerry e-mail devices on Wednesday lost an emergency Supreme Court appeal which sought to put a long-running patent suit against the company on hold.

Research In Motion Ltd. is appealing an infringement verdict to the high court and wanted the lawsuit stalled while the appeal was pending. Chief Justice John Roberts denied the company's request for a stay, without comment.
...

Lawyers for RIM had argued its business would be harmed irreparably if the court did not delay the return of the case to the lower court where the company was found guilty in 2003 of violating patents held by NTP Inc.

The loss on Wednesday, which had been expected, does not say anything about a more significant issue, whether the Supreme Court will hear RIM's appeal.

1. RIM is a big money company.
Just take a train or a bus in any big city and you see people pounding away on their Blackberry. It's a great device.

4. As a Luddite, I couldn't agree more.
I was the "last kid on my block" to have a PC, Walkman, Cellie, Digital camera, and I STILL don't own an I-Pod.

But last year they started handing out Blackberries at work like they were party favours, and I Got Mine.

Wonderfully useful device! Besides the cell-phone, the walkie-talkie feature gets a work-out on campus, especially when we're working on some kind of link "You got signal yet?" "No, try the next port..."
Email is useful, the various memopad and calender features are great, and it's a hoot to be in the big city and be able to see in the weather radar on The Internets shows rain at home or not.

We keep track of each other at trade shows with them, too.

3. Hmmmm
"Chief Justice John Roberts denied the company's request for a stay, without comment.

I wonder if he made no comment because he doesn't have the foggiest idea what the law is.

5. Extremely rare for a denial of cert to be commented on
Do you have any idea the number of requests for certiorari are? Do you know the number which are granted? It may even be a violation of the "case or controversy" clause to "comment" without a fully briefed, argued and voted on decision. These "comments" which you seek would be cited by lawyers and could cause unknown mischief.
