Lawyers for Guantanamo Bay detainee David Hicks are taking the British Government to the High Court over its failure to grant him an English passport.
Hicks, who is accused of fighting alongside the Taliban in Afghanistan, is due to face a US military tribunal within the next month.
The Adelaide man has been held in Guantanamo Bay for almost four years.
Hicks's mother was born in England and his lawyers have been trying to get him a British passport because the UK Government is not allowing its citizens to be tried by the American military. Hicks's lawyers have lodged a High Court application asking that a judge order an early hearing of the case if the Home Secretary, Charles Clarke, does not grant Hicks British citizenship by Wednesday.
