ALABAMA ATTORNEY GENERAL TOLD GOVERNOR HE WOULD HELP UNDERMINE FEDERAL COURTS, AFFIDAVIT ASSERTS

Document Adds To Evidence That William Pryor Does Not Deserve Seat On Federal Appeals Court, Says Americans United

Former Alabama Gov. Forrest H. “Fob” James has released an affidavit
asserting that state Attorney General William Pryor agreed to help him defy the federal courts in a dispute over governmental display of the Ten Commandments.

The document, issued Oct. 24, is further evidence that Pryor holds extreme views and is unfit for a seat on the 11th U.S. Circuit Court of Appeals, says Americans United for Separation of Church and State.

President George W. Bush has nominated Pryor to the appeals court, but Senate opponents are blocking his confirmation, arguing that his views are too extreme. In action today, 43 senators voted to block Pryor’s confirmation, while 51 voted to move to a floor vote on the nomination. (Under Senate rules, 60 votes are required to shut off debate.)

(Capitol Hill-AP) -- Senate Democrats have again successfully filibustered the nomination of Alabama Attorney General William Pryor to the U-S Court of Appeals.

The vote was 51-to-43, nine votes short of the 60 needed to break the filibuster. It is the second time Senate Republicans have failed to overcome Democratic objections to Pryor's nomination. (snip/...)

Democrats block vote on judgeship

WASHINGTON -- Senate Democrats on Thursday again blocked a confirmation vote on Alabama Attorney General William Pryor's nomination to the federal appeals court in Atlanta.

Senate Republicans warned that after appropriations bills are completed, they will hold marathon sessions next Wednesday and Thursday -- all night if necessary -- to try to force votes on Pryor and other judges President Bush has nominated to the federal courts, but Democrats have blocked.

The Democratic filibuster of Pryor's nomination came shortly after the Senate Judiciary Committee approved another Bush nominee, California Supreme Court Justice Janice Rogers Brown 10-9. The party-line vote signaled that Brown's nomination to the D.C. appeals court probably faces the same treatment as Pryor's when it comes to the full Senate.

"Democrats are virtually certain to filibuster Janice Rogers Brown," said Sen. Orrin Hatch (R-Utah), chairman of the Judiciary Committee.

The failure to confirm Pryor marked the second time the Democrats have used the filibuster to block a vote on his nomination to the 11th U.S. Circuit Court of Appeals in Atlanta.

By banding together, the Democrats prevent the Republican majhority from mustrering the 60 votes needed under Senate rules to end debate on the nomination so it can be sent to the floor for a simple up-or-down vote. (snip/...)
