NEW YORK -- A federal appeals court has denied a bid by prosecutors to oust a judge they claimed favored a defendant accused of lying about his relationship with two Sept. 11 hijackers.
In a ruling issued Thursday, the 2nd U.S. Circuit Court of Appeals rejected the government's argument that the trial judge, Shira Scheindlin, appeared biased in rulings since the perjury case against Osama Awadallah went before her in late 2001.
"We do not believe an appearance of justice is in jeopardy," the three-judge panel wrote.

During oral arguments in December, prosecutors cited a 2004 article written by Scheindlin for a legal publication in which she said it was the duty of judges to protect individual rights in the wake of the Sept. 11, 2001, attacks. They argued such public statements and pretrial rulings in Awadallah's favor had created an appearance of injustice in the case.
