Compromise Proposed in Eminent Domain Fight

NEW LONDON, Conn. - The mayor of New London, where a fight over government seizing property led to a controversial U.S. Supreme Court ruling, is proposing a compromise for a group of homeowners.

Under a plan presented to the City Council Monday night, four people whose homes were seized for a private development would be allowed to stay. The city would own their properties and the residents would have to pay the city to live there.


WHow the fuck is that a compromise. IMO that is worse than just taking thier land and paying them. "Gee I guess we can let you stay but now we own your land and you got to pay us."

1. That actually is a compromise on the city's part
Of course before they were going to charge the residents BACK RENT(at a ridiculous rate) and penalties from failing to vacate.

2. For those of you in the Honolulu area
there will be a symposium on Kelo vs. City of New London. One of the participants will be Justice Kennedy, who along with Justices Ginsburg, Breyer, Souter, and Stevens, issued the majority opinion for the court.

Other symposium participants include:

  • Judge Myron H. Brights, U.S. Court of Appelas for the 8th circuit
  • Prof. Joseph Sax, Boalt Hall Law School UC-Berkeley
  • Judge David Ezra, US District Court of Hawaii
  • Prof. David Callies
  • Dean Aviam Soifer


Moderator is Denise Antolini

It will be on Thursday, February 9th, 2006, 1:30 - 4:00 p.m. at the William S. Richardson School of Law, Classroom 2
