Breaking: Rove Meeting With Special Prosecutor About Leak Case

John King, CNN’s political correspondent, just reported:

CNN is told by three force sources familiar with the investigation that this morning Karl Rove, the president’s deputy chief of staff and top political adviser, is meeting with his attorney and is to meet this morning — if it is not already under way — with the special prosecutor, Patrick Fitzgerald. According to sources, the goal of the meeting is for Karl to clear up some lingering questions about his role in a White House campaign to undermine Ambassador Joe Wilson — remember he was the the critic of the Bush administration case ever going to war in Iraq, his wife the CIA operative Valerie Plame, whose name was Outed.

It’s a complicated legal investigation and it has become a complicated political problem for the White House. Our understanding, Karl Rove is meeting with his attorney this morning, meeting with the special prosecutor this morning and the hope from Rove’s camp is that he can answer the few remaining questions about his involvement, his back and forth with reporters, during that time frame, his comments to the FBI and other investigators including the grand jury that is investigating this for quite some time now. And the hope from the Rove camp, all can be resolved and Karl Rove cleared of wrongdoing in the relatively near future.

The AP is also reporting that Fitzgerald went before the the grand jury this morning.

I realize self-preservation is a basic human drive, but Rove would rat out his own mother if it kept him out of jail. However "nervous" Rove might be today, I'm thinking that anyone who has remotely crossed his path in the last five years is MORE nervous.

8. Ya! More scoop from firedoglake.....
http://www.firedoglake.com/

Guess who went back before the Grand Jury this morning, according to the AP? Yep, it’s our boy Fitz.

Special counsel Patrick Fitzgerald early Wednesday went before a federal grand jury looking into the leak of the identity of undercover CIA officer Valerie Plame….

Fitzgerald’s unfinished business includes White House deputy chief of staff Karl Rove, who was under investigation when the previous grand jury that indicted Libby expired.

Rove’s legal problems stem from the fact that it was not until more than a year into Fitzgerald’s criminal investigation that the White House adviser told the prosecutor about disclosing the CIA status of Wilson’s wife to Time magazine reporter Matt Cooper on July 11, 2003.

Rove says he had forgotten the Cooper conversation, which occurred several days before Plame’s identity was revealed in Novak’s column.

Rove and Novak also had discussed the CIA status of Wilson’s wife.

Other unfinished business in the probe focuses on the source who provided Washington Post reporter Bob Woodward information about Plame, whose CIA identity was leaked to Novak in July 2003.

Hmmmmmm…and when you add in a report this morning from CNN’s John King that Karl Rove and his attorney(s) met with Fitz this morning in person, the mind begins to whir, doesn’t it?

I’ll be working the phones as I can today, and no doubt Jane will do the same. More news as we get it folks. It may be cold outside here today, but I think things may be heating up. Here’s hoping…

(Huge thank you to readers angie and yodermon for the heads up on this.)

UPDATE: ThinkProgress got a screen grab of the CNN story and the transcript of what King said. More as I get it…

UPDATE #2: Norah O’Donnell reports on MSNBC that Rove will be testifying today before the G/J for a fifth time in the CIA leak case. I have to say that in my experience, this is really unprecedented — I can’t ever remember any witness who was also potentially a subject in an investigation giving a prosecutor this many under oath opportunities to skewer them. O’Donnell reports that there are serious questions about how forthcoming/honest Rove has been — and that there are potential questions of more legal jeopardy. May be expecting a statement from Rove’s legal representatives some time this afternoon, according to O’Donnell.

15. Rove is likely testifying about other WH biggies.
I would say we're going to see several more indictments, in addition to Rove. In return for his cooperation, Rove'll get much reduced charges.

I would guess, the next to go will be Hadley, followed by Rice, and then Cheney.

20. I disagree. I think Rove is testifying in order to talk the GJ out....
of indicting him. Think he and his lawyer requested a chance to convince GJ that he "forgot" some things but really, really didn't mean to leave certain items out of his previous testimony.

Just Fitz being very fair. Won't matter. Friday that fat sh*t will be hand cuffed and booked.

48. This is the fifth time Rove has testified. He hasn't just been talking
about himself. It also seems implausible that Karl's assistance was really needed to locate and understanding missing e-mail, considering that Fitz has had access to the backup server tapes since September 30, 2003.

Further, Fitz indicated in a letter to the court a couple months ago that he is interested in the July 7 INR, and related documents, as well in its chain of custody that reportedly includes Marc Grossman (State), Libby (OVP and OOTP), Rice (State), Fleischer (WHPO), and others.

So, Karl and Fitz have had a lot to talk about, and it isn't just about Rove.

....if the prosecutor want an indictment. You know the old saw "a prosecutor can get a grand jury to indict a ham sandwich if he wants".

The subject of a GJ probe has little in the way of protections whan testifying. And he can't have his lawyer with him as a coach.

83. That's a horrible characterization of a grand jury.
They see the raw you-better-believe-it's-prejudicial evidence that defense lawyers get excluded. Rove's good fortune is that this isn't the same group of people who have been listening to him lie for years. And, yes, you can bloody well tell when someone is lying under oath. They get tics. Twitches. Their voices choke. Then the prosecutor asks a question that can be answered truthfully and their bodies and voices relax. the relief is so palpable at being able to be truthful that the lie stands out in neon colors.

The negative for Rove is that the grand jury is really it for him. White collar criminals do NOT want a public trial with a jury of their peers. Because it won't be. It will be pissed off poultry judging the fox. So he's making whatever deal he can to avoid that.

Remember, he volunteered to testify before when he feared being indicted. This is happening again. Fitz is happy to let Rove dig a bigger hole, I'm sure. BTW, Rove's attorney has confirmed he is a subject in the investigation.

Bush Fears Tenacious, Popular Wellstone
by John Nichols
snip--
Most of them also asked a question: "How come Bush hates you so much?"
snip---
As Wellstone prepares to seek a third term next year, it would be reasonable to assume that he might finally be in for some smooth political sailing. But reasonableness doesn’t figure into the calculations of the Bush White House, where the president himself, Vice President Dick Cheney and political commissar Karl Rove practice the politics of vengeance.

The Bushies despise Wellstone, who unlike most Senate Democrats has been fighting spirited battles against the new administration’s policies on everything from the environment to the tax cuts for the rich to military aid for the "Plan Colombia" drug war boondoggle. Other Democratic senators who face re-election contests in 2002 are, according to polls, more vulnerable than Wellstone. But the Bush camp has been focusing highest-level attention on "Plan Wellstone" — its project to silence progressive opposition.
snip---
Minnesota is not the only state where the Bush camp is seeking to pick senators. But the level of involvement in the Wellstone race is remarkable. Coleman dropped a planned gubernatorial bid after two White House pressure sessions with Bush. And now that Coleman is leaning toward a Senate race, Bush, Cheney and Rove are pulling out all the stops to make sure they are in charge of the anti-Wellstone effort.

Source: Rove to Testify in CIA Leak Case

By JOHN SOLOMON 13 minutes ago

WASHINGTON - Top White House aide Karl Rove prepared to testify Wednesday for a fifth time before the federal grand jury investigating the leak of a CIA officer's identity, a person familiar with the case said.

Rove consulted with his private lawyers before a scheduled afternoon court appearance and was prepared to answer questions about evidence that emerged since his last grand jury appearance last fall, the person said, speaking only on condition of anonymity because of grand jury secrecy rules.

That new evidence includes information that emerged late last year that Rove's attorney had conversations with Time magazine reporter Viveca Novak during a critical time in the case.

Special Prosecutor Patrick Fitzgerald met with the grand jury Wednesday. Among other things he is investigating why Rove originally failed to disclose to prosecutors that he had talked to Time magazine reporter Matt Cooper about the outed CIA operative,
Valerie Plame, back in 2003.

131. Very good point
Five times in front of a grand jury?! Even if a guy is completely innocent of wrongdoing (which almost certainly does not describe Rove), an attorney would be remiss to let his client appear that many times in front of a grand jury. Each and every time in front of a grand jury the chance of the client contradicting or, worse, perjuring his or herself rises exponentially. So yeah, I would think it is safe to say that Rove is talking about more than just himself.

32. talks also of other "unfinished business"
Other unfinished business in the probe focuses on the source who provided Washington Post reporter Bob Woodward information about Plame, whose CIA identity was leaked to Novak in July 2003.

Plame's identity was exposed eight days after her husband, Bush administration critic and former U.S. Ambassador Joseph Wilson, alleged that the U.S. government had manipulated prewar intelligence to exaggerate an Iraqi nuclear threat.

Woodward says his source, who he has not publicly identified, provided the information about Wilson's wife, several weeks before Novak learned of Plame's identity. The Post reporter, who never wrote a story, was interviewed by Fitzgerald late last year.

57. What's with these DC lawyers. That seems obvious to me and I'm
just watching as a concerned citizen. I mean prosecutors do this all the time in organized crime
cases. Oh, forgot, the organized crime in DC isn't really "criminal" since it's allowed by statute and regulation. Sorry, silly me. DC lawyers just know the legal phenomenon known as the "vast right wing conspiracy."

38. Let's all keep in mind this is really distraction from the root cause....
The root of leaking Plame's identity wasn't to harm the credibility of Wilson. It had the "benefit" of also outing Brewster Jennings and helped DICK to cover his ass from his involvement in Iran and the warmongers' efforts to go to war with Iran.

Outed CIA officer was working on Iran, intelligence sources say
http://www.rawstory.com/news/2005/Outed_CIA_officer_was_working_on_0213.html

The unmasking of covert CIA officer Valerie Plame Wilson by White House officials in 2003 caused significant damage to U.S. national security and its ability to counter nuclear proliferation abroad, RAW STORY has learned.

According to current and former intelligence officials, Plame Wilson, who worked on the clandestine side of the CIA in the Directorate of Operations as a non-official cover (NOC) officer, was part of an operation tracking distribution and acquisition of weapons of mass destruction technology to and from Iran.

Speaking under strict confidentiality, intelligence officials revealed heretofore unreported elements of Plame's work. Their accounts suggest that Plame's outing was more serious than has previously been reported and carries grave implications for U.S. national security and its ability to monitor Iran's burgeoning nuclear program.

Quote from Hersh's The Coming Wars ties into Plame outing
http://www.democraticunderground.com/discuss/duboard.php?az=show_topic&forum=364&topic_id=895103

http://www.newyorker.com/fact/content/?050124fa_fact

In my interviews, I was repeatedly told that the next strategic target was Iran. “Everyone is saying, ‘You can’t be serious about targeting Iran. Look at Iraq,’ ” the former intelligence official told me. “But they say, ‘We’ve got some lessons learned—not militarily, but how we did it politically. We’re not going to rely on agency pissants.’ No loose ends, and that’s why the C.I.A. is out of there.”

Remember, Hersh wrote this over a year ago and we all remember the incredible pieces done by Larisa at RawStory of late, esp. the one about the damage done to the CIA due to Plame's outing (she was working on WMD proliferation in/out of Iran).

With the CIA out of the way, the Pentagon intelligence agencies have free reign to produce any kind of evidence they want and submit it to the public after being massaged.

IMO, war with Iran is inevitable.

112. What's to reply to?
A bunch of strung together imaginings with imaginary sources from the infamous RawStory dream factory, together with some other speculation? And from this you derive that the outing was actually a ploy to cripple the network so we could attack Iran? I mean, really. Let me know when you finish the novel. I suspect it's good reading, if internally incoherent.

But we’ve looked at prosecutor Patrick Fitzgerald’s record as far as designating people as Official A or Official B, and in every single case we have found, Keith, that prosecutor Patrick Fitzgerald when he designates somebody as Official A in an indictment, that person eventually does get indicted themselves. And that’s why I think with everything coming together there is so much intrigue tonight about Karl Rove.

And it reveals a lot about the nature of their own character, as well: They know that 50% of Rove's success is his use of dirty tricks.

Almost without fail, in every campaign where Rove has been in charge or played a major role -- for Bush, for Bill Clements, whoever -- there has been at least one major, bizarre dirty trick played out: the leaking of info to the press during Bush Sr's 1980 presidential bid; the fake "bugging" of Rove's office during the 1986 Clements/White Texas gubernatorial campaign; the fake telephone polls about an alleged Ann Richard "staff of lesbians" in the 1994 Bush Jr./Richards gubernatorial race; the spreading of McCain "black love child" and "gay" rumors in the 1999 S.Carolina GOP primary; the appearence of the SmearVets in 2004.

94. Target Letter Drives Rove Back to Grand Jury
Edited on Wed Apr-26-06 02:50 PM by Roland99
http://www.truthout.org/docs_2006/042606I.shtml

Karl Rove's appearance before a grand jury in the CIA leak case Wednesday comes on the heels of a "target letter" sent to his attorney recently by Special Prosecutor Patrick Fitzgerald, signaling that the Deputy White House Chief of Staff may face imminent indictment, sources that are knowledgeable about the probe said Wednesday.

It's unclear when Fitzgerald sent the target letter to Rove's attorney, Robert Luskin. Sources close to the two-year-old leak investigation said when Rove's attorney received the letter Rove volunteered to appear before the grand jury for an unprecedented fifth time to explain why he did not previously disclose conversations he had with the media about covert CIA operative Valerie Plame and her husband, former Ambassador Joseph Wilson, who criticized the Bush administration's use of pre-war Iraq intelligence.

A federal grand jury target letter is sent to a person in a criminal investigation who is likely to be indicted. A "target" of a grand jury investigation is a person who a prosecutor has substantial evidence to link to a crime.

Last week, Rove was stripped of some of his policy duties in a White House shakeup orchestrated by incoming Chief of Staff Joshua Bolten. The White House insisted that Rove was not demoted, but insiders said the executive branch is bracing for a possible indictment against Rove.

:woohoo:

117. Robert Luskin: "Rove is not a target"

http://www.cnn.com/2006/POLITICS/04/26/cia.leak/index.html

Rove entered a Washington courthouse shortly after 1 p.m. ET and remained in the building for nearly 3 hours.

"Karl Rove appeared today before the Grand Jury investigating the disclosure of a CIA agent's identity. He testified voluntarily and unconditionally at the request of Special Counsel Patrick Fitzgerald to explore a matter raised since Mr. Rove's last appearance in October 2005," Rove's attorney, Robert Luskin, said in a written statement.

"In connection with this appearance, the Special Counsel has advised Mr. Rove that he is not a target of the investigation. Mr. Fitzgerald has affirmed that he has made no decision concerning charges.

"At the request of the Special Counsel, Mr. Rove will not discuss the substance of his testimony," Luskin said.

Also, notethis sentence: "In connection with this appearance, the Special Counsel has advised Mr. Rove that he is not a target of the investigation."

In connection with this appearance Rove isn't targeted, he is just requested to appear. Something's up. If he's not targeted, someone else is. Cheney?

116. "FITZ, DON'T FAIL ME NOW!"
...so someone used to proclaim.

I'm a bit more pessimistic. I think that ultimately we'll have to settle for a Scooter for Fitzmas. But hey, that is much, MUCH more thah I thought we would get when Fitz started his investigation, especially after Abu Gonzales gave everyone in the White House a "heads up" notification to destroy incriminating documents.

120. This is Only the Beginning
Regardless of what happens in this case, this is only the beginning. America is about to get an enima and the right wingers will be the laughing stock of the World if not villain #1. People are pissed and the pain has only begun...

So Merry Fitzmas and a Happy Jackoff

126. Big correction coming
When Rove goes down, a lot more questions get asked. These trials will open up everything and at a slow grinding pace. Democrats will control the press daily.

133. More bad news...
Edited on Wed Apr-26-06 09:18 PM by Loge23
Jason Leopold reports that Rove actually received a target letter. http://www.truthout.org/docs_2006/042606I.shtml
Guess that seals it - nothing to see here, folks.

121. Kool Hand Karl
He should be able to lose some weight on the new diet, Tossed Salad and Buchenwald lite. Fat Karl no more. In just six months he'll have a new profile and changed attitude. Got your mind right yet Karl?

137. can't wait to see how the BushCo gang is treated by the other prison gangs
Just hope BushCo's not sent to some high class Club Fed where they can play golf all day. I think they should do something good for America, like pick up road trash.
