Reimbursement for Santorum's children still unresolved

A dispute over whether a school district can recover tax money it paid for U.S. Sen. Rick Santorum's children to attend an Internet-based charter school remains unresolved a year after a hearing officer recommended that the state dismiss the case.

The Penn Hills school board in suburban Pittsburgh has sought a refund of tens of thousands of dollars in tuition from the Pennsylvania Cyber Charter School, which enrolled five of Santorum's six children even though the family lives primarily in Leesburg, Va.

Mr. Santorum, R-Pa., who also owns a smaller home in Penn Hills, withdrew his children from the Midland-based cyberschool in November 2004, but it has become an issue in his re-election campaign against Democratic nominee Bob Casey.

State Education Secretary Gerald Zahorchak has not decided whether to accept the hearing officer's July 2005 recommendation to dismiss the school board's challenge, department spokesman Mike Storm said yesterday. Mr. Storm would not say why Mr. Zahorchak has not reached a decision.

2. I thought the "test of residency" was where do you live
for the greater part of the year. Isn't this so for income tax purposes?

I don't understand why this issue is so hard to resolve. Anyone from W. PA knows he doesn't live in that small home in Penn Hills.

I hope this drags out throughout the summer/fall so it is indeed a campaign issue.

4. Nah, that hasn't been a requirement since
three days before George W. Bush announced who his VP candidate in 2000 would be ... but it did matter if your name has a (D) after it ...

3. If it were legally proven that Santorum does not have a residence in PA
then that means....he could not legally represent the state...and that means that Casey would win just by default.

I really wish there were funds to test whether or not Santorum meets the guidelines for residency.
