New Suit Filed in Janklow Case
AP) The family of a motorcyclist killed when former Rep. Bill Janklow ran a stop sign has filed a new $25 million wrongful death suit against the U.S. government....

Scott's family initially sued Janklow in Minnesota state court. But it was determined that since Janklow was on official business, he was protected from any monetary claims by the Federal Tort Claims Act. The law safeguards on-duty federal employees from negligence claims.

The case was then moved to federal court. But the family's initial claim against the U.S. House went nowhere.

Janklow, 66, resigned from Congress after being convicted in South Dakota of second-degree manslaughter and other charges stemming from Scott's death.

The 2003 crash ended Janklow's political career. He had dominated South Dakota politics for three decades, first as attorney general, then as governor and finally as the state's only member of the U.S. House.

1. Janklow is back in the thick of politics again...

... he got his law license back (his old cronies gave it back to him) and is fighting Kevin Scheiffer, former US Senator Larry Pressler's (R-SD) chief of staff in federal court, for, would you believe MAYO CLINIC of Rochester, Mn? Sheiffer is the head of the Dakota, Minnesota, and Eastern Railroad that is pushing for $2.5+ billion in Federal Railroad Act funds to run high speed coal trains from Wyoming to Chicago and other points east. Janklow (juvenile delinquent ordered to the Marines) always harbored extreme contempt for Pressler (a Rhodes Scholar) and is taking the Mayo suit against the railroad for free.

The proposed line passes one block from Mayo Clinic in Rochester, and if there was a derailment, access to the hospital/clinic would be blocked.

2. Janklow needs to stop avoiding responsibility for this. He's been
given deeply favorable protection by the court. He's a very lucky Republican:

Randy Scott, 55, was killed Aug. 16, 2003, when his motorcycle hit the back of the Cadillac Janklow was driving when he sped through a stop sign at an intersection near Trent.

Janklow, who suffered a head injury, said he hadn't eaten that day and had a diabetic reaction on his way from Aberdeen to his Brandon home.

The former state attorney general, governor and congressman stood trial in December 2003 in his boyhood hometown of Flandreau and was found guilty of second-degree manslaughter, reckless driving, speeding and running a stop sign.
(snip)

Janklow, 66, a dominating force in South Dakota politics for 30 years, was given a suspended imposition of sentence, which means his record will be clear if he complies with the terms of probation.

Janklow is one lucky man in the fact no one seemed to mind his reckless driving and speeding has been a habit going back as far as his days as a governor, when state and local police looked the other way. He nearly killed people then, who have made public statements concerning his bizarre, dangerous driving habits.

He's a man who clearly has abused the authority given him by the voters. It's a real shame these voters were never given the facts about how he was handling the responsibility they had given him before this happened.
