1. If these justices look at more civilized countries, they will know.. |
|
the right side of history is to not discriminate against same sex couples.

2. either way the consequences will be bad |
|
If the Court says yes, then that's good that gays can get married, but then the Right will have some fresh red meat for this year's elections, and all the usual tripe about "activist judges".
If the Court says no, then that's bad because gay/lesbian civil rights will have been further abridged.

3. Not in WA - they cant use ammendments here |
|
In WA state a constitutional amendment can not be gotten via signature drives. It must be approved by the senate and the house with the Governors signature (I.E. it is not going to happen).

6. They've been sitting on this decision for more than a year |
|
If the Supreme Court of Washington keeps the ban on gay marriage after making the plaintiffs wait for this long, I'm going to be incredibly ticked off.

The Court will pull a Vermont and drop the ball squarely on the State Legislature. Candidates for the state House and Senate will make a great deal of political hay vowing either to support full, equal marriage or to oppose anything that might possibly be construed as legal recognition of same sex relationships. Both sides will roundly condemn the Court, especially the candidates running for judicial office, as being weak, spineless, unprincipled and either "hate-filled bigots who refuse to acknowledge the very clear language of the state constitution" or "activist judges forcing a lifestyle of depravity on the people of these United States." The judges, on the other hand, will breath a collective sigh of relief at having transfered voter ire away from themselves while generating as little voter backlash against themselves as possible.
Call me a cynic if you must, but I ain't holding my breath.

8. I can see that scenario happening |
|
but what ultimately happens then? Is there a bill out of the Democratically controlled Washington State Legislature, that gets signed by Democratic governor Chris Gregoire? It wouldn't happen before the fall elections without a special session, it would be politically easier to do this next year, I would think.
