Fiction over fact' in 9/11 show

US network ABC "chose fiction over fact and entertainment over education" by misquoting Clinton administration officials in The Path to 9/11, it said.

The former president's aides were angry at suggestions he failed to deal with an Islamic militant threat before 2001.

"Their claims of edits notwithstanding, The Path to 9/11 had Clinton administration officials saying things they did not say and doing things they did not do," claimed spokesman Jay Carson in a statement.

"Many of these scenes are directly contradicted by the 9/11 Commission Report. The American public deserved better."

15. Free Speech did NOT end the tort of Slander.
Edited on Mon Sep-11-06 01:01 PM by happyslug
Now you may state your OPINION on something and even dramatized it, you can NOT pass a lie off as the truth under the concept of "Free Speech". Much like one can NOT yell "Fire" in a crowed theater, one can NOT LIE and say it is the TRUTH.

Now OPINION is protected, if the writers had said I THINK Clinton left bin Laden go, that is protected free speech, but once you put words in Clinton's month that Clinton did NOT SAY, and that puts him in a bad light, that is SLANDER.

Clinton can not sue comedians about the Jokes about him and women do to the Monica affair (For example the Joke that came out about that time based on the finding that teenage pregnancy was down, Why were teenage pregnancy down? because Clinton was to busy in the White House). That joke had a basis in fact, Clinton is known to like women and was a giggle at his expense do to this "problems" with women. Thus it is Slander, but not actionable for it is a statement of opinion based on Clinton's own actions. Ont he other hand this Movie put words into Clinton's (and other in his administration) month that Clinton did NOT say, NOR did they reflect what Clinton was doing. One can say of Clinton he did NOT do enough o get bin Laden, one can say Clinton should have sent in Troops against bin Laden, but one can NOT say things that ARE UNTRUE and DID NOT HAPPEN. The burden will be on Clinton to show 1, he did not say what the movie shows him saying, 2. those statement cause Clinton HARM, 3. those statements are stated as FACT not Opinion.

Remember the US rule is something is NOT slander under the First Amendment if the WRITER does NOT know if it is FALSE (Truth is an absolute defense) but the Writers are saying this is based on the 911 report and the report is DIFFERENT from the 911 report. Clinton needs to make the argument that the difference is intentional and design to be harmful to Clinton, if the Judge and Jury accept that argument Clinton can still win his liable action even if he is a Public person.

Now in US usage public officials often have to prove Malicious intent on part of the person who is stating the slander, but if I was Clinton I would wait till this show is shown in England and sue ABC and the writers in England, which has a much lower set of standards when it comes to Slander. I would also be tempted to sue in the US, even if the Court would rule this picture is within the concept of Opinion.

3. And already this morning, ABC is RAMPIN' UP THE FEAR!
"Could it happen again?"
"New Al Qaeda warning?"

Sick. The Republican fearmongering agenda is absolutely BEYOND disgusting at this point.

4. Isn't it unreal?
I feel like I'm in an incessant Alice in Wonderland tea party! The madness....the tactics....the fear...the nonsense. Is there an Al Qaeda..."yes". Can this group do dangerous things?, "yes". Are we trying going after them in a 'productive way', "No". Instead, the fearmongering agenda is used to control US. If it weren't so serious it would be laughable.

5. Hey Hugh, do you know if they aired that disclaimer during the
movie? (It said: "For dramatic and narrative purposes, the movie contains fictionalised scenes, composite and representative characters and dialogue, as well as time compression.") If so, that should be mentioned anytime anyone is talking about the movie to others "yeah, they admitted at the beginning it's a pack of lies for dramatic purposes".

7. From reports by people who actually WATCHED it . . .
They said that very disclaimer was used, that it contained some fictional scenes.

That's funny for a movie that had a trailer that said "The OFFICIAL TRUE STORY".

Report....and then showed official statements from the 9/11 Commission Report at the beginning of the 'drama'. i don't think that this fucking flip-flopping should cover their asses on putting out lies on our nation's history!

6. They thought that they were gonna brainwash everybody,
get the world to feel pity, concern, admiration, whatever, for the criminal cabal.

They just won't give up the idea that the majority of the people on this planet are just not that stupid and we lived through 911, the 2000 election, the Clinton years, and we WERE PAYING ATTENTION.

All they got left are the dumb asses and Diebold/ES&S.
