(10-31) 04:00 PST Sacramento -- The state's prison guards union and another union went to court Monday to stop Gov. Arnold Schwarzenegger's plan to ship thousands of California inmates to private, out-of-state lockups.
Arguing the governor was violating the state Constitution by contracting out for prison services, the unions asked a state Superior Court judge for a temporary restraining order and filed a lawsuit as a prison guards union executive blasted Schwarzenegger for "shipping his problems off to somebody else."
The administration is preparing to send inmates to prisons in four other states as early as next month. The administration earlier this month signed contracts with two private prison companies that call for housing 2,260 inmates in facilities in Indiana, Arizona, Tennessee and Oklahoma.
Schwarzenegger has said the out-of-state transfers are needed to alleviate overcrowding in California's 33 prisons, but the unions said Monday the governor is breaking the law. Joining the prison guards was the Service Employees International Union, Local 1000, which represents many other prison employees such as teachers and food service workers.
