Assault Charges Filed Against Allen Staffers

Charges have been filed against the men who allegedly roughed up a heckler at a George Allen campaign stop.


Mike Stark, a UVA law student, says the men put him in a choke hold and threw him out of the room after he asked Allen about a rumor that the senator had spit on his first wife.

Besides, there have been no such statements from Maccaca or his boys about this being self-defence, etc. so far as I'm aware.

That was an unprovoked assault. A verbal question is not a provocation.

At one point, Stark moved towards them and brushed up against one (in an apparent attempt to get by).

The people in question can legitimately call as a defense that they became fearful that Stark (who was becoming verbally belligerent) could have been attempting to assault one of them.

(To be honest, I know if a guy approached my wife like that, I'd do the same thing.)

I still hope they have to at least appear in court and defend themselves, just like anyone else would have to.

Nice to know chivalry isn't dead, but Allen is a big guy, not the "little woman" - seeing the tapes I fail to see anything "agressive" in Starks behaviour except for a pointed question.

At 23 seconds in this particular video, Stark tries to get around one man during the argument (it had just begun) and bumps into the man with the white shirt from behind in an attempt to approach Allen.

That can be considered an "aggressive behavior" as Allen and company were making an attempt to get away from Stark.

I'm not saying I agree with Allen's team, or know which way a jury would decide, but it IS a reasonable defense.

thrown into a glass window, and it was all captured on videotape. This seems like a slam dunk case for the prosecutor. The Allen staffers will probably have no choice but to plead guilty.
