Miss. Attorney Asks Out of Nomination

JACKSON, Miss. -- A Mississippi attorney asked President Bush to withdraw his nomination
to the 5th U.S. Circuit Court of Appeals, saying he doesn't believe the senior Democrat
on the Senate Judiciary Committee considers him a consensus nominee.

Jackson attorney Michael Wallace, 54, told The Associated Press on Tuesday that he
made the request in a letter sent late last week. The New Orleans-based 5th Circuit hears
cases from Mississippi, Louisiana and Texas.

Wallace wrote that he believes a majority of the Senate would consent to his nomination.
However, he said that incoming Judiciary Committee Chairman Patrick Leahy, D-Vt.,
"made it clear two weeks ago that he intends to permit vacancies to be filled only with
'consensus nominees'" and that Leahy has indicated he doesn't consider Wallace to be
such a nominee.

In February, Bush nominated Wallace to fill the 5th Circuit seat vacated by Judge Charles
Pickering Sr., who left the court more than a year ago. In November, Wallace's name was
among six judicial nominations Bush resubmitted to the Senate.

A Mississippi lawyer asked President Bush to withdraw his nomination to an appellate court, saying that he does not believe that the senior Democrat on the Senate Judiciary Committee considers him a consensus nominee.

Michael B. Wallace


President George W. Bush nominated Michael B. Wallace to a seat on the Fifth Circuit Court of Appeals on February 8, 2006. Wallace received an unanimous "Not Qualified" rating by the American Bar Association's (ABA) Standing Committee on Federal Judiciary (a first for a Court of Appeals nominee in 24 years). On August 3, 2006, Wallace's nomination was returned to the President, under the provisions of Senate Rules XXXI paragraph 6 of the Standing Rules of Senate. President Bush renominated Wallace September 5, 2006. The Senate Judiciary Committee returned his nomination to the President on September 29, 2006. President Bush renominated Wallace November 15, 2006. Wallace's failed nomination was returned to the President on December 9, 2006.

Words like "nasty," "dismissive," "abusive," "mean," "rude," "extremely arrogant," "egotistical," "condescending," and "extraordinarily impolite," were used, as well as information on his bigotry, starting around page #12, 13, 14, reference to actual hostility toward people different from himself would tell me he's an idiot after the heart of people like Bush. Heck, he sounds just like John Bolton, doesn't he?

He's a former aide to Trent Lott. Say no more! Wink, wink, nudge, nudge.

All returned to * from committee. I think the guy is saying "Please, don't nominate me again", I would if I were him.

Why is * trying to nominate somebody that received a "not qualified" rating from the ABA anyway?
