WASHINGTON (Reuters) - Two federal appeals court judges on Tuesday
appeared to support giving lawyers for Guantanamo prisoners access to
all the U.S. government's evidence when challenging the detainee's
designation as an "unlawful enemy combatant."
Two of the three judges who heard arguments in the case expressed
concern about the Bush administration's proposal to limit the prisoners'
lawyers just to evidence presented to the U.S. military tribunal that
made the determination.
Lawyers for the prisoners argued they should get access to all
documents compiled by the U.S. government when it decided to make
the enemy combatant designation. That might help them find
information that would clear the detainees, they said.
"Why shouldn't the court and the counsel see all of the evidence?"
Judge Judith Rogers asked the government's lawyer. "Who knows what
evidence was gathered?"
