Gun-Rights Group Must Modify Its 'Bloomberg Gun Giveaway' (Va.)

McLEAN, Va. (AP) - A gun-rights group planning a "Bloomberg Gun Giveaway" in response to lawsuits against two Virginia gun shops by the New York City mayor must modify the contest to comply with state law, county officials said Wednesday.

The VCDL organized the gun raffle to raise money for the gun shops being sued as well as to poke a thumb in the eye of New York Mayor Michael Bloomberg, who the league believes has unfairly targeted legitimate gun dealers. Bloomberg has called the giveaway's organizers "sick people."

Customers received raffle tickets for every $100 they spent at the two stores, Bob Moates Sport Shop in Richmond and Old Dominion Gun and Tackle in Danville. The drawing will be held in a Fairfax County government building in Annandale.

But on Wednesday, Commonwealth's Attorney Robert F. Horan Jr. told the league that such a raffle would be illegal under the state's gambling laws. To comply with the law, the contest must be open to anybody who attends Thursday's event, even if they never spent a dime at the two gun shops.

New York City officials have sued more than two dozen gun dealers from Georgia, Ohio, Pennsylvania, South Carolina and Virginia in federal court. The lawsuits were filed after private investigators went into the stores with hidden cameras and simulated an illegal straw purchase _ in which one person fills out the paperwork and buys the gun for somebody else.

So let's see if I have this right. Mayor Bloomberg objects to illegal gun sales that contribute to crime in NY, so this group is having a gun raffle as an intentional dope slap to uphold the right to sell guns illegally in Virginia, but you can only have a gun raffle to uphold the right to sell guns illegally in Virginia if anyone can enter the raffle. It can't be limited. (I think that was right. My head is still spinning.) A gambling law applies, not a gun control law.

And the drawing will be held in a government building. Thanks, Virginia.

3. WE have a law coming into effect on July1 making it illegal

not the straw purchases (those are already illegal but clearly not enforced) and not this gun raffle in what ever form it is now taking.

No WE are going to outlaw Bloomberg doing what HE did.

Last month, Mr. McDonnell sent Mr. Bloomberg a letter warning him that as of July 1 a new Virginia law would outlaw New York from sending undercover agents into the state to illegally purchase guns.

Mr. McDonnell's office cited a news report in which Mr. Bloomberg's office said Virginia State Police would now be notified of stings targeting illegal gun sales.

"We caught gun dealers on video tape flagrantly violating the law," Mr. Post said. "We wish that the attorney general would put as much time into enforcing the laws already on the books as he does on issuing press releases and engaging in needless turf battles."

7. Interstate transport of guns is a real problem.

Many of the guns used in crimes can be traced to a few dealerships. 'Bout 10 years ago a van full of "auto parts" was busted in NY with nearly a hundred semi-auto handguns purchased in Dallas, TX. All were "legally" purchased by local crack addict (straw buyer) that had no convictions over a weeks period.

The record of those purchases was locked safely in each of the stores that unknowingly sold to this straw buyer. None of the other sellers could know that this one person bought so many guns in such a short period.

The state by state system of patchwork laws isn't working. We need one federal tracking system that registers buyers into a national database with each purchase tied to that buyer by serial number and uploaded to the instant background check immediately on purchase.

There are probably ways to flag straw purchases like that that would be acceptable to gun owners, but the compilation of a "Who Owns What and Should We Let Them Keep It?" list isn't one of them, IMO.
