Trial Opens Involving CIA Rendition

MILAN, Italy -- The first trial involving the CIA's extraordinary
renditions program opens Friday in the absence of all 26 American
defendants accused of kidnapping an Egyptian terrorist suspect.

The trial, which has been an irritant in the historically robust U.S.-
Italy relationship and coincides with the arrival in Rome of President
Bush, was expected to ground to a halt before taking off.

The government has asked Italy's highest court to throw out
indictments against 26 Americans _ all but one of them believed to
be CIA agents _ accused of abducting Osama Moustafa Hassan Nasr,
also known as Abu Omar, from a Milan street on Feb. 17, 2003.

The Constitutional Court was expected to consider that and a similar
appeal in the fall, and participants in the trial said they expect
defense requests to postpone the trial until after the high court rules.

2. CIA agents go on trial in Italy before Bush visit
Hours before President George W. Bush visits Italy, 26 U.S. citizens go on trial in absentia in Milan on Friday accused of carrying out one of Washington's most controversial policies in its war on terrorism.

The U.S. citizens, almost all believed to be CIA agents, have been charged with kidnapping a Muslim in Milan in 2003 who was on Washington's list of terrorist suspects and flying him to Egypt where he says he was tortured under interrogation.

Italian spies, including the former head of the country's SISMI intelligence agency, are accused of helping the U.S. citizens carry out the so-called extraordinary rendition.

Washington has said it will reject any request by Italy to extradite the accused.

PARIS - The CIA ran secret prisons in Europe, including in Poland, said the head of a European investigation who was to present new findings Friday on what he has called a "spider's web" of human rights abuses during the war on terror.

"We have proof, on the basis of information collected, of the existence of illegal prisons in countries closely collaborating with the United States, such as Poland," the French daily Le Figaro quoted Swiss senator Dick Marty as saying.

Marty, leading an inquiry on behalf of the Council of Europe, has spoken to former CIA agents to corroborate his earlier accusations against Poland and Romania, where he suggested CIA planes landed to drop off detainees, a person familiar with the investigation said.

Marty was to release his latest findings Friday. In Romania, a senator who headed a panel investigating the allegations on behalf of the Romanian parliament rejected Marty's conclusions.
