Libby asks judge to delay sentence

WASHINGTON - Attorneys for I. Lewis "Scooter" Libby formally asked a
federal judge Thursday to delay the former White House aide's 2 1/2-year
prison sentence, a request the judge has indicated he's not inclined to
grant.

In documents filed with the court, Libby's attorneys say they have a
good chance of winning an appeal of Libby's conviction for perjury and
obstruction in the CIA leak case. Jurors found that Libby lied to
investigators about how he learned that the wife of an outspoken war
critic worked for the CIA, and whom he told.

During Libby's monthlong trial, attorneys disagreed with several of U.S.
District Judge Reggie B. Walton's decisions, including prohibiting them
from presenting an expert witness to testify that Libby could have simply
forgotten his conversations because of the stress of his daily job.

2. Good try guys, but fuess what? You really shouldn't have pi**ed
off the judge during the trial! Your client is going to pay the price!

I'm willing to bet this BS piece of paper isn't going to change the judges mind. Scooter, back your toothbrush!

22. Paris used the same technique I tried to use to flunk my
Selective Service physical in 1969, don't eat or sleep for three days. Didn't work for me.

And what is this? Didn't this get shot down previously?

"Defense attorneys argued in their filing Thursday that Special Prosecutor Patrick Fitzgerald lacked the constitutional authority to bring charges against Libby, the former chief of staff to Vice President Dick Cheney."

JANICE ROGERS BROWN/DAVID B. SENTELLE/SENIOR JUDGE
LAURENCE H. SILBERMAN



On the D.C. Court of Appeals, Sentelle voted to overturn the convictions of Oliver North and John Poindexter, along with Judge Laurence Silberman. He was one of the judges responsible for appointing Kenneth Starr to replace Robert B. Fiske as lead independent council to investigate President Bill Clinton.

14. Wrong Court
Your list is from the City Court of Appeals, not the D.C. Federal Court of Appeals!!!

Since Libby was tried in a Federal court the city court doesn't have any say.

15. Sorry. My bad.
I'm at work and that was shoddy Googling. Still, three out of 14 isn't so terrible. But, I don't really know any of the others except for Tatel. They didn't buy Judy's "inalienable right not to testify" however, so who knows.

17. Actually it's only ten
Two seats are currently vacant and the remaining four judges are senior and listed as inactive, including Silberman, but I guess they can always be asked to return.

So that leaves Brown, Sentelle, and Kavanaugh in the Libby pocket!

11. They can't accept Fitz destroyed the memory expert in pre-trial.
And he did. It was short, brutal legal bloodsport too violent for network TV. The memory expert came off as a fool and continuing to attempt to litigate that losing argument deserves nothing but cold mockery.

20. I would let him off the hook
If he told the truth about the whole inside dealings of this sordid affair and exposed how they set up Valerie in retaliation for Joe's article and comments about the failure to find credible evidence that Saddam was trying to get uranium from niger.

I would even give him immunity from future prosecution of course the Bushit and Insaney will be going down heavy after that.
