Supreme Court to Review Guantanamo Cases

WASHINGTON (AP) -- The Supreme Court, reversing course, agreed Friday to review whether Guantanamo Bay detainees may go to federal court to challenge their indefinite confinement.

The action, announced without comment along with other end-of-term orders, is a setback for the Bush administration. It had argued that a new law strips courts of their jurisdiction to hear detainee cases.

In April, the court turned down an identical request, although several justices indicated they could be persuaded otherwise.

The court did not indicate what changed the justices' minds about considering the issue. But last week, lawyers for the detainees filed a statement from a military lawyer in which he described the inadequacy of the process the administration has put forward as an alternative to a full-blown review by civilian courts.

So, I read this as SCOTUS opening the door on the issue of inadequacy.....

1. YEAAAH!
They may have been influenced by the massive ACLU rally just outside their doors on Tuesday. All those people marching on D.C. to restore habeas corpus might have gotten to them.

...I think the SCOTUS is about to validate the end of habeus corpus and give free rein to the giggling murderer in the WH...

3. Given the rulings yesterday, this just doesn't strike me as good news
This court is certainly not above ignoring the Constitution and re-writing it to reflect the bush doctrine as we saw yesterday.

9. I hold out the hope----
the double-edged hope that the abuses will be so transparent as to motivate the "true" conservatives on the court...

Perhaps this is the case to prove that Gitmo is "so-bad"........

Optimist, I know,.....

But one can hope that the 4th, 5th, and 6th still hold some charm...........
