Marine Gets Time Served in Iraqi's Death

(08-03) 09:10 PDT CAMP PENDLETON, Calif. (AP) --

A jury sentenced a Marine corporal Friday to time served and reduced his rank to private for conspiring to murder an Iraqi civilian during a frustrated search for an insurgent.
Cpl. Marshall Magincalda, 24, has already served 448 days in custody and was to be freed Friday.

He was acquitted of murder but also found guilty of larceny and housebreaking, and cleared of making a false official statement.

Outside the courtroom, Magincalda's mother and grandmother wept as they embraced.

"We can take him home. God answered our prayers," his grandmother Wynoma Leesch said.

3. This was on NPR yesterday-they hid in an orchard, couldn't find their actual target,
so the grabbed another guy, put him in a roadside hole, put a rifle and a shovel in there so it looked like he was planting an IED and then Magincalda himself shot the guy several times and said "Gents we just got away with murder"

They determined yesterday that is was NOT premeditated.

A US marine has been sentenced to time served and demoted to private for conspiring to murder an Iraqi civilian during a raid near Baghdad last year.

Cpl Marshall Magincalda, who was also convicted of theft and housebreaking, has already served 448 days in custody.

He was a member of an infantry unit which shot dead Hashim Ibrahim Awad, 52, in Hamdaniya on 26 April 2006.

On Thursday the leader of the unit, Sgt Lawrence G Hutchins III, was convicted of unpremeditated murder.

Sgt Hutchins faces a maximum sentence of life in prison.

A US marine has been sentenced to 15 years in prison
for the murder of an Iraqi civilian during a failed search
for an insurgent by the unit he led.

Sgt Lawrence Hutchins was convicted of unpremeditated
murder for the killing of Hashim Ibrahim Awad, 52, during
a raid near Baghdad last year.

Another member of the unit, Cpl Marshall Magincalda,
was convicted of conspiracy to murder.

He was sentenced to time served and demoted to private.
