Sources: Spitzer Resignation Expected Wednesday
Source: WCBS

NEW YORK (CBS) ― Gov. Eliot Spitzer is set to resign Wednesday, sources tell CBS 2 HD political reporter Marcia Kramer, but insiders say he's going to use the resignation as a bargaining chip to cut a deal with federal prosecutors and he won't step down until that happens. The talks have been going on since Tuesday morning.

The governor's fate rests in the hands of two people: U.S. Attorney Michael Garcia and Michele Hirshman, the head of his legal defense team. The deal they cut will determine Spitzer's future.

Criminal law experts say Spitzer will definitely have to resign the governorship and that what's involved in the deal is key.

3. Nice that the guy can cut deals ensuring that he's not prosecuted in
exchange for his going into retirement. We should all be so lucky (if we ever get into trouble).

But after negotiating all day there was still no deal Tuesday night. Spitzer doesn't have the luxury of playing deal or no deal. Experts agree that his involvement in a prostitution ring makes him damaged goods.
"I think his career is politically at an end," noted criminal defense attorney Ronald Fischetti told CBS 2 HD.

14. The Lt Gov, David Paterson
He should be a great Governor.

He'll be the first black Governor of NY. Probably the first blind Governor ever.

However, I think the Republican Pres of the Senate takes on the Lt Gov role.

I don't understand why some here choose to support him just because he's a Democrat. He's a huge hypocrite who got caught with his pecker where it shouldn't be.

Ditch him and try to save face. He should not drag this out because it will be much more damaging to the Democrats in NY if he does.

13. Spitzer is the governor.
He can leave office or stay. Mann Act charges are pretty rare, especially in a case like this. If having had mistress has not harmed McCain's path to the presidency, and if even that sleaze Rudy Giuliani was able to run a fairly serious campaign, Spitzer should be able to stay on. After all, Vitter and Craig are still in office. Many Democrats want Spitzer to leave office, but the fact is that he does not have to.
