National Lawyers Guild Calls on Boalt Hall to Dismiss Law Professor John Yoo,
Source: National Lawyers Guild Press Release

In a memorandum written the same month George W. Bush invaded Iraq, Boalt Hall law professor John Yoo said the Department of Justice would construe US criminal laws not to apply to the President's detention and interrogation of enemy combatants. According to Yoo, the federal statutes against torture, assault, maiming and stalking do not apply to the military in the conduct of the war.


The federal maiming statute, for example, makes it a crime for someone "with the intent to torture, maim, or disfigure" to "cut, bite, or slit the nose, ear or lip, or cut out or disable the tongue, or put out or destroy an eye, or cut off or disable a limb or any member of another person." It further prohibits individuals from "throwing or pouring upon another person any scalding water, corrosive acid, or caustic substance" with like intent.

Yoo also narrowed the definition of torture so the interrogator must kill the person or cause organ failure or permanent loss of significant body functions in order to constitute torture; Yoo's definition contravenes the definition in the Convention Against Torture, a treaty the US has ratified which is thus part of the US law under the Constitution's Supremacy Clause. Yoo said self-defense or necessity could be used as a defense to war crimes prosecutions for torture, notwithstanding the Torture Convention's absolute prohibition against torture in all circumstances, even in wartime. This memo and another Yoo wrote with Jay Bybee in August 2002 provided the basis for the Administration's torture of prisoners.

"John Yoo's complicity in establishing the policy that led to the torture of prisoners constitutes a war crime under the US War Crimes Act," said National Lawyers Guild President Marjorie Cohn.

14. The Provost is making a big mistake.
When the Torture memos first came out, I remember demonstrations on campus. But, they were merely revolting without actually being as criminal as this last disclosure.

He needs to be arrested and imprisoned for war crimes. Then, no one will have to worry about academic freedom and tenure. He can his academic freedom in a jail cell.

Just writing about war crimes does not make one guilty of committing war crimes. He wrote his legal opinion but I don't believe he ever actually participated in torture...Bush* now on the other hand is ultimately responsible for acting on Yoo's opinion and putting it into practice..

If he wrote an academic book on the subject, that would be one thing. He wrote memos that authorized it, thereby allowing it to continue.

On edit: another thread in this section included the recommendation from the lawyers' organization that he be tried for war crimes. I imagine they know what a war crime is.

Note, however, that a citizen of one of the 'objector nations' could still find himself before the Court if he were accused of committing war crimes in a country that was a state party, regardless of the fact that their country of origin was not a signatory.

War crimes are defined in the statute that established the International Criminal Court, which includes:

- Grave breaches of the Geneva Conventions, such as:
- Willful killing, or causing great suffering or serious injury to body or health
- Torture or inhumane treatment

He issued a Legal "Opinion". By your reasoning any lawyer would be guilty as well as their client if their client were to be found so. Bush* on the other hand is quite guilty of authorizing torture and we really have no idea how important Yoo's opinion was in Bush* making his decision. Don't get me wrong, I find Yoo's opinion despicable and at odds with existing international and US Law and he should not be teaching Law anywhere but guilty of a war crime, I don't think so.....

Biography

John Yoo is a professor of law at the University of California at Berkeley School of Law (Boalt Hall), where he has taught since 1993. From 2001-03, he served as a deputy assistant attorney general in the Office of Legal Counsel of the U.S. Department of Justice, where he worked on issues involving foreign affairs, national security, and the separation of powers. He served as general counsel of the U.S. Senate Judiciary Committee from 1995-96, where he advised on constitutional issues and judicial nominations.

Professor Yoo received his B.A., summa cum laude, in American history from Harvard University. In law school, he was an articles editor of the Yale Law Journal. He clerked for Judge Laurence H. Silberman of the U.S. Court of Appeals of the District of Columbia Circuit. He joined the Boalt faculty in 1993, and then clerked for Justice Clarence Thomas of the U.S. Supreme Court.

Professor Yoo was a visiting professor at the University of Chicago Law School in 2003 and at the Free University of Amsterdam in 1998. In 2006, Professor Yoo held the Distinguished Fulbright Chair in Law at the University of Trento (Italy). He has received fellowships from the Olin Foundation (for work on treaties and constitutional law) and the Rockefeller Foundation (for a book on the effects of globalization on American constitutional law). He has received the Bator Award for excellence in legal scholarship and teaching from the Federalist Society.

Professor Yoo has published articles on foreign affairs, national security, and constitutional law . He is the author of The Powers of War and Peace: Foreign Affairs and the Constitution after 9/11 (University of Chicago Press, 2005) and the forthcoming War by Other Means: An Insider's Account of the War on Terror (Atlantic Monthly Press, 2006).

...with simply a green card, but look at how close he became involved with the highest levels of power and the influence he was able to exercise over issues which no moral American attorney steeped in the love of the U.S. Constitution and the history of American conscience would ever have advised a president to pursue, torture of children no less. Good God!

and I began wondering about the names. Are Korean names and surnames used like they are here; first, middle, last? Or do they vary and are they interchangeable like Hispanic names? Hispanics usually have a first name, a middle name, a mothers maiden surname and a fathers surname. I've know individuals that that interchange the mothers and fathers surnames and that's what got me thinking. How common is the surname Yoo or Choon? Is Yoo really a surname? Is Moon? How common is the surname Moon? Are the surnames interchangeable? I'm really ignorant When it comes to this subject, so my search for a connection was a dead end.
