Colorado GOP Asks for Redistricting Stay

January 27, 2004


Colorado Republicans asked the U.S. Supreme Court Monday to temporarily block the state's congressional redistricting map, which favors Democrats, saying state Supreme Court justices wrongly threw out their own plan.

If a stay is granted, Colorado Secretary of State Donetta Davidson would use the GOP-drawn alternative in November's elections, which includes two hotly contested races.

Republican state legislators said the existing redistricting plan, passed in 2002, violates Colorado's constitution because it was drawn up by a judge and not state lawmakers.

The Colorado Supreme Court tossed out the GOP alternative, saying the judge had the right to draw the map because lawmakers took too long to come up with one themselves.

Ever see how WE reacted to the opposite decision in TX?

Same thing. A bunch of politicians trying to defend their jobs.

3. Is this a state matter or a federal matter?
Seems to me, the Constitution placed full discretion for deciding election related matters in the hands of the states, which is why every state uses different means for electing candidates, apportioning electors, etc. So why should the Federal Supreme Court have any say in deciding Colorado law? The State Supreme Court has already ruled that the Constitution says redistricting can be done only one every ten years. It was supposed to be done by the Legislature, but when they failed to agree on a plan, it feel to the courts to impose one.

Of course, I'm sure states rights only court to Scalia when it comes to segregation.

9. It IS.
The state supreme court ruled on the basis of their interpretation of the state Constitution. The Supreme Court is extremely unlikely to overrule a state court in their own baliwick without a claimed conflict with the US Constitution... and I can't see what that would be.

5. When did Colorado last redistrict through legislative action?
I believe I read an article in the Denver Post that judges have filled in for the legislature for the past thirty years. Also, in 1934, the Dems tried to redistrict like the Repubs did this year, and it was thrown out by the courts. It seems "timeliness" may be an issue.


Gee, hubris and all. These guys really think they can do no wrong, and God loves only them. :evilgrin:

10. Apparently 3 federal judges
already refused to intervene. I can't imagine SCOTUS getting involved after that, unless * et al are really concerned about the electoral map. :shrug:
