9th Circuit judge had sexual images on Web page

LOS ANGELES - The chief judge of the 9th U.S. Circuit Court of Appeals posted sexually explicit photos and videos on a Web site he maintained that he has now blocked to the public, the Los Angeles Times reported today on its Web site.

The revelation about Judge Alex Kozinski came as opening statements were under way in an obscenity trial he is presiding over in U.S. District Court in Los Angeles.

Kozinski, 57, told the Times that he thought the material on his Web site, which included a video of a man cavorting with a sexually aroused farm animal, couldn't be seen by the public. He took the site down and said he didn't believe any of the images were obscene.

"Is it prurient? I don't know what to tell you," he told the newspaper. "I think it's odd and interesting. It's part of life."

Otherwise, I'm not going to make moral judgments. "Cavorting", unless it's an euphemism for sexual activity, isn't against the law. His worst crime is really poor judgment, excusable even from a judge

Even neutered male animals can display "arousal", without any provocation or obvious stimulus. If that's the worst thing on his webpage, it's probably embarrassing to him but isn't in any way actionable.

Human capacity for moral condemnation of others is ridiculous. I detest this man's politics but do not care about his personal preferences.

I wasn't very concerned about Clinton's BJ either; just the politicizing of it.

19. Not the 10th Circuit

I've practiced before the 10th Circuit. The article you linked relates to U.S. Dist. Judge Edward Nottingham, who's the chief judge of the District of Colorado, one of the districts that the Tenth Circuit comprises. Judge Nottingham has had an interesting run of news stories about him lately, and the entire district as a whole (which is coterminous with the State of Colorado) is chronically under-judged.

14. Um, before you all jump on the "He's a Republican, let's laugh!" bandwagon...
I should note that the 9th Circuit Court of Appeals is generally considered the most liberal federal court in the country. Does any one know about any decisions made by this guy in particular? If he *has* genuinely supported 1st Amendment rights in his rulings, I don't see anything wrong here.

He's out of step with the Ninth Circuit as a whole and is alternately described as a conservative and a libertarian. He was a clerk to A. Kennedy and Burger and was a Reagan appointee to the Ninth Circuit when he was only 35, 23 years ago.

It's a very curious story.
