Ex-Clark Co. (Indiana) GOP chief admits performing oral sex on a sleeping man
Source: Louisville Courier-Journal

The former chairman of the Clark County Republican Party pleaded guilty today to criminal deviate conduct as part of an agreement that could result in two years behind bars.

Glenn Murphy Jr. was arrested after authorities said he performed oral sex on a sleeping man following a July 28 party at a home in Jeffersonville. The plea agreement calls for a six-year sentence, with four years suspended.

Murphy is free on a $25,000 bond pending his June 30 sentencing.

Murphy, who was also chairman of the Young Republican National Federation, resigned from both posts when the allegations were made public in August.

Trying to orally 'service' someone doesn't really constitute the invasion and humiliation of rape. Sure, it's a violation, but it just doesn't rise to that level.

34. That's a fair point, but...
our justice system does tend to try to quantify damage to a degree.

This is obviously not a violent assault such as rape, and the criminal justice system does not much acknowledge 'emotional' damage... and for good reason. Rather, civil court is where such a thing should be addressed.

Let him take a few lumps in criminal court for sexual harrassment/abuse, then take him to civil court and sue his pants off... so to speak.

83. Under Indiana law rape can only happen between a man and a woman.
It should not be less than the minimum sentence for rape. But haven't found anything indicating what min and max is for that felony. Both are class B felonies.

The 22-year-old man who brought the complaint told investigators that he and Murphy were among a group of people who spent the night at a home after a party there, according to an affidavit by Detective Randy Burton of the Clark County sheriff's office.

Murphy slept on a top bunk while the man slept on a lower bunk, the affidavit said. The man said he awoke at 6:40 the next morning and found Murphy performing oral sex on him, according to the document.

The man told Burton that he pushed Murphy away and left.

Two days later, the affidavit said, the man met with Murphy and secretly taped a conversation during which Murphy apologized and begged him not to report the incident to police.

There are many, many reasons why someone would find it objectionable, or a violation. Maybe the recipient is straight, or maybe he's married or in a relationship and takes his commitment seriously, or maybe he's concerned about transmittal of an STD. Or maybe he'd rather be a willing, informed participant.

JEFFERSONVILLE — A Clark County judge is expected to rule later this month on whether the statements of three men who claim Glenn Murphy Jr. sexually assaulted them can be admitted into evidence for his upcoming criminal deviate conduct trial.

On Monday, Special Prosecutor Stan Levco of Vanderburgh County filed a memorandum in Clark County Superior Court No. 1 in relation to the former Clark County Republican Party chair’s class B felony case. The charge stemmed from Murphy allegedly performing unwanted oral sex on a man in a Jeffersonville home in July.

The memorandum cites that the state has evidence that Murphy performed similar unwanted acts on three other men as follows:

It may feel physically good, but emotionally it's at least as bad as being felt up, and is almost certainly much worse.

Now, it's not like the guy made the others do anything for him, so it is a bit different than being penetrated or forced to perform oral/etc. on someone, but it's pretty up there as far as violating things have occurred.

I don't think I'd be as upset, being gay, as a straight guy is, but I can imagine being upset.

Along with the prison sentence, Murphy would have to register as a sex offender for the rest of his life, according to the Courier-Journal newspaper in Louisville, Ky.

Murphy, 34, attended a party July 28, 2007 at the unnamed victim's sister's home, where both men spent the night. Later that night, the victim, 22, awoke to find Murphy performing oral sex on him against his will, according to special prosecutor Stanley Levco.

The plea bargain called for a six-year prison term, with four years suspended, meaning Murphy could spend as little as one year in prison under Indiana's policy of reducing sentences by one day for each day of good behavior. Clark County Superior Court Judge Vicki Carmichael said she would deliver a formal sentencing June 30. Murphy is free on $25,000 bond.

Murphy resigned as chairman of the Clark County, Ind., Republican Party and of the Young Republican National Federation last August when the allegations were made public on the blog of Indiana Democratic Party spokesperson Jennifer Wagner in August 2007.

50. It's the fact that it's nonconsentual, and that it's not sexual intercourse.
Non-consentual oral and anal sex falls under the heading of "criminal deviate conduct," in either direction, for any gender.

In this case, because it was done without the other person knowing (at first), it's a class B felony. If it had been done using force or drugs, it would be a class A felony.
