Military lawyers objected to harsher interrogation

Military lawyers warned against the harsh detainee interrogation techniques approved by Defense Secretary Donald Rumsfeld in 2002, contending in separate memos weeks before Rumsfeld's endorsement that they could be illegal, a Senate panel has found.

The investigation by the Senate Armed Services Committee also has confirmed that senior administration officials, including the Pentagon's then-general counsel William "Jim" Haynes, sought information on a program involving military psychologists early on to devise the more aggressive methods — which included the use of dogs, making a detainee stand for long periods of time and forced nudity, according to officials familiar with the findings.

The officials spoke on condition of anonymity because the information has not been formally released. Details, including the names of the service lawyers who objected to the interrogation techniques, were to be discussed at an open committee hearing Tuesday.

Rumsfeld's December 2002 approval of the aggressive interrogation techniques and later objections by military lawyers have been widely reported. But the November protests by service lawyers had not, and the interest by Pentagon civilians in military psychologists has surfaced only piecemeal.

A Senate investigation unveiled today found that senior Pentagon officials began planning to use abusive tactics at Guantánamo Bay earlier than they previously acknowledged, borrowing from a programme that trained US troops to resist cruel interrogations.

New documents disclosed today show that lawyers in the army, navy and marines objected vigorously to the use of violent methods against detainees but were overruled by aides to the former US defence secretary, Donald Rumsfeld.

After the Abu Ghraib prison scandal cast scrutiny on Rumsfeld's December 2002 approval of 15 interrogation methods - including forced nudity and hooding of prisoners - Pentagon advisers claimed that the tactics originated with lower-level officers.

According to witness testimony today, Rumsfeld's senior lawyer began inquiring about controversial new tactics three months before a junior military officer first put the 15 methods in writing.

WASHINGTON (AP) — Military officials tasked with training U.S. troops to evade enemy interrogations provided Pentagon lawyers a list of abusive tactics that could be used in prisons like Guantanamo Bay, a top Senate Democrat disclosed Tuesday.

Sen. Carl Levin, chairman of the Armed Services Committee, said the harsh techniques were then pursued despite strong objections in November 2002 by the military's uniformed lawyers.

"If we use those same techniques offensively against detainees, it says to the world that they have America's stamp of approval," said Levin, D-Mich., at the onset of a committee hearing.

"That puts our troops at greater risk of being abused if they're captured. It also weakens our moral authority and harms our efforts to attract allies to our side in the fight against terrorism."
