Group Quickly Sues To Overturn Chicago Gun Ban

U.S. Supreme Court: Americans May Own Guns For Protection, Hunting; Ruling Casts Doubt On City's Decades Old Law

CHICAGO (CBS) ― The U.S. Supreme Court says Americans have a right to own guns for self-defense and hunting, and the ruling will likely invalidate the 26-year-old ban on handguns in the City of Chicago.

In fact, the Illinois State Rifle Association has already filed a lawsuit challenging the Chicago ban. They filed the suit within 15 minutes of the high court's ruling.

The 5-4 ruling specifically struck down a ban on handguns in Washington, D.C. The court ruled that the District of Columbia's 32-year-old ban on handguns is incompatible with gun rights under the Second Amendment. The decision goes further than even the Bush administration wanted, and leaves most gun laws intact, but could invalidate Chicago's.

The Supreme Court ruling does not automatically invalidate the Chicago handgun ban, but opens up the possibility of a court challenge that could get it declared unconstitutional.

I figured that Chicago's ban would be next. I don't think any other major city has an actual ban on firearms. I believe there are some smaller communities, though. I suspect those will be next.

1. 15 minutes huh?
Not surprising. But I really doubt that in 15 minutes they had time to completely read and digest the Supreme Court ruling.

Now that the "individual right" part has been settled, it is only natural that the 14th amendment incorporation question comes next. The court probably saw this coming too.

and ready to go, in case of a win.

If further reading gave them pause, they could motion to change the original draft or withdraw the suit without cost.

Some prestige among constituents to be the 1st org to sue.

4. Lets put more guns on the streets of Chicago.
Great idea everyone, Makes total sense to me.
The more guns the safer we all are...right? :sarcasm:

Why are people so narrow minded. Example: I need my damn pistol everywhere i go, because if the guy next to me has one i need to protect myself.

MAYBE. If the guy next to you didn't have a gun, and the guy next to him didn't have a gun, and the woman next to him didn't have a gun. Then YOU wouldn't need a damn gun.

THINK. For once. More guns is never a good thing.

About what is going on inside of other peoples' heads.

This isn't about "needs" or the number of guns. It's about self-determination. If you don't want a gun, don't buy one. If you don't want them in your house, banning them is your prerogative. Nobody is going to argue with you about that.

More guns is never a good thing.

As a federally licensed gun collector who regards firearms as a significant component of my retirement savings, I'm going to have to go ahead and disagree with you about that.

7. Take the guns from the criminals and maybe those narrow minded people,
who are concerned with their families protection and the polices inability to protect them, will be willing to listen to you.

11. Dear U.S.A.
Lifting the ban makes total sense, especially on the day a guy goes 'postal' and kills five of his co-workers. What were those people thinking? Why weren't they packing? Why didn't the company have mandatory firing practice for its employees? How stupid are these so-called victims?

Unfortunately, U.S.A., I'm afraid I've got to lay it on the line for you. You're nuts. Gun nuts. While here in Canada we've managed to basically keep the lid on pointless automatic weapons, you've been no help at all. Like a nymphomaniac with VD, you just can't keep it to yourselves. Your media is filled with gun violence, your politicians are hooked on pro-gun money and even in the aftermath of such horrendous acts as yesterday's, you still don't get it. And probably never will.

12. Your automatic weapons problem
Is not our fault. Ours have been tightly regulated since the 1934 National Firearms Act. In lots of states here in the US they are completely illegal for non-military or police (or manufacturers), and in the states where it is legal, you are registered with the BATFE, pay a $200 tax per weapon, and are subjected to a background check (not just a NICS check) and the BATFE might check up on you to make sure you still have it, from time to time.

Ordinary American civilians are not packing automatic weapons. I can't even buy one in my home state, no matter how much money I have.

If you don't like our gun laws then build a wall and pull out of NAFTA or you could just mind your own business.

Edited on Thu Jun-26-08 04:50 PM by depakid
;)

Unfortunately, most people don't- and so they and their children will have to live with the senseless gun violence and repeated mass shootings that will haunt America in ever greater frequency as petroleum prices rise and the nation sinks further into economic hardship.

17. It appears to me that the fix was in. The Gun Pushers knew in advance what the decision was
The Gun Pushers at the Illinois State Rifle Association must have had an advance copy of Justice Antonin Scalia's brief. I would be suspicious that old Wayne LaPierre at the NRA didn't help write it.

The Gun Pushers win, we lose.

What this country needs is less gun ownership by private individuals, not more.

25. Leaking of Scalia's brief may seem'tinfoil hat' but
Justice Scalia and Vice President Cheney know each other.

http://www.cbsnews.com/stories/2003/12/15/politics/main588582.shtml

(CBS) Vice President Dick Cheney and Supreme Court Justice Antonin Scalia spent part of last week duck hunting together at a private camp in southern Louisiana, just three weeks after the court agreed to take up the vice president's appeal in lawsuits over his handling of the administration's energy task force, the Los Angeles Times says in its Saturday editions.

26. ROFLMAO, if you paid any attention to the case when it was being argued...
you would realize that the lawyers for the District of Columbia pretty much had no case. So it was almost expected that it would go our way, but alot of gun owners were still pretty nervous and didnt want to get our hopes up.

Since so many were expecting the case to go well for us other people made their plans for what next steps to take.
