BREAKING: Federal Judge Compels GOP 'IT Guru' Mike Connell To Give Deposition in Ohio '04 Election Case
Contentious Hearing Today Results in Order For Republican 'High-Tech Forrest Gump' to Testify Under Oath on Monday
Appearance to Answer Questions on 2004 Election Scheduled Just 24 Hours Prior to Election 2006...

The Republican IT guru, recently described as a "high tech Forrest Gump" for his proclivity to be "at the scene" of so many troubling elections since 2000, and even at the heart of the "lost" White House email scandal, has been ordered by a federal judge to appear for an under-oath deposition next Monday in Ohio.

The BRAD BLOG has learned that Mike Connell, the Republican IT guru whose company, SmarTech Inc. created Ohio's 2004 election results computer network appeared in federal court today, as compelled, and has been ordered to appear for his deposition on Monday, November 3, just 24 hours before Election Day 2008.

Today's court order came after a contentious hearing, at which Connell was present. The hearing was part of a long-standing voting rights violations lawsuit, King Lincoln v. Blackwell, as previously covered by The BRAD BLOG and by Velvet Revolution's Election Protection Strike Force here and here.

Though Connell's attorneys have fought to quash the subpoena, recently issued after the judge lifted a stay on the case several weeks ago, , it looks like his options to avoid testimony, or at least jail for avoiding it, may have come to an end. The attorneys in the case have said that Connell's testimony may well lead to the subpoenaing and under-oath questioning of Karl Rove, who, they say, would be unable to use Executive Privilege as an excuse to avoid such a subpoena in a civil RICO case...

There needs to be a constitutional ammendment that says the president cannot pardon any person under his supervision or acting under his direction or the direction of his cabinet or staff, or for anything that could be any kind of a conflict of interest.

This will go nowhere because it is built on nothing.

The claim that somehow displaying the wrong numbers online can change an election is laughable and spurious!

Not to mention:

Ohio 2004 was 3/4 punch cards, with op-scan and e-vote in the few remaining counties.

The e-vote counties shifted to significantly more Dem votes for Kerry than Gore.

This inquiry should focus on how punch card ballots were cast for Kerry and counted for Bush,
not on who displayed the results on the Internet on election night.
When the counties reported their results, the fraud had already happened.
This focus OBFUSCATES the Kerry-Bush vote-switching.

Remember Blackwell rec'd 500,000 from the RNC which is illegal becuz they are only supposed to donate to those who run in national races not local. But, even if this produces no conviction, I am hoping that it will send a chill to those who think that election fraud is just a prank with no legal consequences. I must admit I find McCain's comments on a tight race with late night results alarming.

the activities of CREEP and their sabotage of the democratic campaign was well documented during Watergate, but there has never been a real legal accountability for this activity. I am more concerned about exposure to prevent future manipulations than a roll back to the 2004 election.

in my view, in that "exposure" is not creation of a spurious scenario with no basis in fact.

In my view, "exposure" is revealing facts (as I'm doing in posts herein), facts like Ohio 204 was 3/4ths punch cards, Kerry did better than Gore in e-vote counties, .......

There are also lots of activities documented in Ohio 2004. See the Conyers report! That is exposure, albeit hurried and as yet incomplete.

If there were "real legal accountability for this activity" at the least Conyers would have returned to it as Chair of his Comm. I assume he considered that pointless under the Bush Junta Department of Injustice!

but until there is legal penalties it will go on. The curtain must be pulled back and this activity has to be exposed. I consider this to be in the same box as the fragrant law breaking the has occurred throughout the executive branch since 2000. They have felt that they are above the law and that the end justifies the means.

The counties tabulate their votes. They know what their tallies are. That is the whole idea behind counting!

Can you define "the incident"?

Appearances can be deceiving my friend, and that is what we are all up against.
This tread illustrates how appearances suffice. Now, drop some money in their hat and MOVE ON! LOL

Seriously, I do statistical research of elections, and I've focused on Ohio 2004.
Greater than common knowledge is difficult to judge if you lack same.

Revealing actual facts about election irregularities serves the ends of achieving justice for any crimes.
Anyone who thinks they needed a Rove in the WH on a computer, or hacking connty tabulators, to steal Ohio missed the miscounting of the ballots.

you want to, including rOves office in the white house, or making it available to a select group before the rest of the world sees it, provides an opportunity for skulduggery. The bUsh campaign had the opportunity to see the data before anyone else and provide direction based on the data, however nefariously, to Ohio election workers who in turn were directing poll workers counting ballots, announcing results and directing election logistics.

Don't discount the value of early data.

The numbers are no secret. They are public information. It is available upon tally to all observers.

You write, "bUsh campaign had the opportunity to see the data before anyone else" and you say this without supporting your claim. I call Bullshit! The data could not get to the Bush Administration without someone seeing it first. The people counting the ballots see it first, and at that point, it is public information and official information.

I have watched an election get fixed. I have watched campaign workers commit felonies. I have a little background in politics. But, in this case, a little thinking is all you need to see the spurious nature of the claims about the "nefarious" role of the SmarTech computer in TN and associated skulduggery by Rove.

I'm not saying there was no crime. I'm saying look at the crimes instead.

How is that bullshit?

The question is of course, how was the early acquisition of data used? Did it provide a legal strategic advantage? My sense is that seeing the data early assists the criminals in their criminal behavior, whatever it was. That's for the court to decide.

You seem to discount the value of seeing the data early on in the disclosure process. Simply having a continous up to date supply of election results available permits you to react strategically.

And the question is, was the access legal, did it permit direction to be given to campaign staff and partisan election workers to lets say, create lines and long waits, lose ballots, miscount, etc. etc.

I think that partisan election workers would want to and be able to keep a race close. Then it can be decided on absentee ballots which have been adjusted to achieve a desired outcome. There is ample opportunity to do that and cover your tracks when you know which precincts to target through out the voting process.

There was an extended period when the Ohio SoS did not update the web server late in the evening. When the results were finally updated, the lead had shifted to Bush.

If election workers are fixing results, they need only move the ballots to another precinct to turn a Kerry vote into a Bush vote.

Do that once, and the vote tally difference changes by two votes!

Of course, that can result in lots of messed up votes for down-ticket races like judges and ballot measures!
That is exactly the scenario we have. And, those punch card vote-switches recount the same every time.

Spoonamore's conclusion is speculative. What has been found is evidence that the system was hackable, not evidence that it was hacked.

Even the evidence that the system was hackable is shaky. The schematic obviously doesn't show all the security systems. For example, it doesn't show where or how firewalls were used. There is zero possibility that there were no firewalls in place. The schematic just wasn't purposed toward illustrating security. It also doesn't indicate security policies of any of the individual servers or applications running on those servers. Obviously that doesn't mean there were no security policies; the schematic just doesn't show them. There's also nothing in this schematic that shows whether or how the various county tabulators were internet-connected or what security measures they had in place. SmartTech having access to those county tabulators through the internet is a key part of Spoonamore's theory.

lala's article gives a balanced view by including the opinion of David Dill who, like I do, believes that there is at most evidence that the system could have been hacked, not that it was, and he doesn't believe there is enough information to be able to say for sure that it could have been. Here's an excerpt:

Dill told Raw Story the schematics are inconclusive and that he continues to have questions after reading Spoonamore's latest affadavit, although he cautioned that he himself is not an expert in Spoonamore's specialty of network security.

"Basically, the whole thing seems highly speculative," Dill said. "It's important to distinguish 'possible' from 'probable' here. I don't even know if this is possible. More details about how the tabulators worked in those particular counties, who was managing them, how the results were uploaded, whether they were all the same kind, etc. would help establish that."

"As to 'probable' -- I don't think that's been established at all, unless one starts with the presumption that the election was stolen and works backwards from there," he added. "I don't think Spoonamore has made the case that SmartTech and Triad '.. reversed the outcome of the 2004 Ohio Presidential Race.' I don't know that it DIDN'T happen, but, at this point, I think we need to demand better evidence."

"Neither I nor Spoonamore have any special knowledge on exit polls or Ohio voting patterns in judicial races," Dill continued. "I'd urge you to take a close look at what skeptical political scientists have written. It's been a long time, but I was left with the impression that proof was lacking."

The counties count the vote, then send it along to the Sec. of State. Then what?

Do they destroy the information in case someone wants to change the numbers on the internet?
That's just frikkin' stupidly laughable! NO, they have to record their votes. And everything must still match later on. HELLO. Any logic left in the world???

Then, they count absentee ballots, provisionals, etc., and submit official election result which they later report by the deadline, as required by statute.

So, it takes about a 70 IQ to realize someone will notice if the county votes are changed. D'oh!!

So, just for the sake of argument, let us hypothetically suppose those having legitimate access to one part of the SmarTech server in TN (i.e. Rove) could, in real time, get into the part of the server with the Ohio 2004 election results. If they changed those results, they would not match the Ohio results that the counties tallied, and which are a permanent legal record and accounted when reporting their official results.

So, so what if the results display server was hackable???

Vote-switching and punch cards were not counted as cast altered the results before the ballots were counted.
Why not focus on that fact? Or is that the whole idea, to avoid a focus on why the punch cards did not tally as counted?

but they make some false assumptions themselves.

If someone was to steal votes the best place to do so would be from Democrat vote rich area because they would not flip the local results but could contribute enough votes to flip the whole state which is what was the target. SO the fact that Kerry did better than Gore does not prove that Democratic votes were not stolen nor is it a reliable indicator. The question is - and always was - how many were actually cast statewide.

The availability of real-tile information can be a valuable tool to those manipulation a system if if that information itself was not directly hacked. It gives them the opportunity to make early decisions about which way things are going and to manipulate other weaknesses in the entire system.

And wasn't part of the issue about Ohio that sample recounts were shutdown and the votes made inaccessible. Your protestation that the counts eventually (more or less) balanced doesn't prove much because that early access gave them time to perhaps apply other and even more traditional election fraud actions and take multiple efforts to plan and cover any actions they took.

146. Your points are valid. But, consider how Ohio ballot box stuffing works.
The way you "stuff" an Ohio punch card election is to move the ballot to the next precinct, where Dem punched votes all count as R votes.

Here is the background on how the system worked in 2004:

Punch card ballots w/o precinct marks count correctly only if punched in the correct precinct and IF the ballot remains in the correct precinct!

So yes, real-time knowledge of county tallies as they happen can be employed to project how many ballot boxes need some stuffing.
However, the method is ballot box stuffing, so the tally reflects the fraud.
There is NO NEED to change the county totals and, in fact, that could lead to detection!!

Also yes, you steal votes where there are votes to steal.
Hence, look first to Cuyahoga County with 1/8th of the Dem votes in Ohio!
These litigants ignore Cuyahoga County even though evidence from Cuyahoga could handily win their Civil Rights case.
They know all about it, I've discussed it with them, but they do not use the evidence.

a lot of reports in the public sphere to suggest that, as far as implication in major crimes are concerned, he's hardly been a dilettante. I think it unlikely that when the people vainly subpoenad, on the basis of putative executive privilege, have been brought to book, he could well be arraigned on multiple charges.

129. Federal Courts Very Hostile to Civil Rights claims in Florida
I've filed civil rights claims in the United States District
Court for the Northern District of Florida and have found that
the Magistrates act like defense lawyers, doing everything in
their power to dismiss your claim without even serving it on
the State of Florida.  I've complained about police conspiracy
to commit perjury in police reports in order to justify their
use of taser.  I've complained about the prosecutor conspiring
with the police and other witnesses to commit perjury.  I've
complained about The Florida Bar refusing to investigate ANY
allegations of government lawyer misconduct (as all other
Florida agencies).  I've complained about the Florida Supreme
Court exempting all State Attorneys completely from any ethics
investigation while they hold office.  Most of my complaints
were dismissed because they would "undermine a criminal
trial."  In other words, folks, the District Courts have
interpreted your civil rights in the criminal court room right
out of existence for purposes of claims filed under section
1983 of the civl rights act.  This judicial interpretation
does not square with the language of the act, and creates no
detterent from State governments from violating your civil
righs at trial, even if they engage in criminal activity!!! 
yes, the neo-naze, oops I mean neo-conservative "state's
rights" movement in the Federal courts is just wonderful.

147. Everyone has real-time access as the votes are counted
if they arrange for that. There are observers at the counts.

HOWEVER, not everyone has access to the ballots before they are counted.

The fraud happens before the ballots reach the tabulators,
when votes cast for Kerry are cast at the wrong precinct (inadvertence or misdirection) OR
ballots are moved to a precinct where a punch for Kerry counts for Bush (purposeful fraud).

Once you understand how to fix a punch card election in Ohio-----before counting the votes (like D'OH!),
this lawsuit's current trajectory seems more like a cover-up than anything else.
Either that, or at the very least, these folks are either totally clueless or caught fishing between a dismissal and a hard spot!

There is enough evidence to win a summary judgment in a flash, if they would just submit it to the court!
