(Senator) Kyl issues warning to Obama on Supreme Court appointments
Source: Phoenix Business Journal -

Jon Kyl, the second-ranking Republican in the U.S. Senate, warned president-elect Barack Obama that he would filibuster U.S. Supreme Court appointments if those nominees were too liberal.

Kyl, Arizona’s junior senator, expects Obama to appoint judges in the mold of U.S Supreme Court Justices Ruth Bader Ginsburg, David Souter and Stephen Breyer. Those justices take a liberal view on cases related to social, law and order and business issues, Kyl said.

“He believes in justices that have empathy,” said Kyl, speaking at a Federalist Society meeting in Phoenix. The attorneys group promotes conservative legal principles.

Kyl said if Obama goes with empathetic judges who do not base their decisions on the rule of law and legal precedents but instead the factors in each case, he would try to block those picks via filibuster.

Anybody Chimpy would nominate tomorrow would NEVER get the fifty votes necessary to be confirmed by the Senate at this point. Even if Joementum voted with the Repukes.

I cannot imagine any of the current Justices resigning in the middle of a term, they usually wait until July to do this.

143. I'd hope for that, but we need younger progressives no matter who they're replacing.
The right-wingers would resist retiring, in all likelihood. Justices who are concerned about a rightward slide in the court should retire so they can be replaced by someone younger.

I thought the "dead and all" part made the satire clear. Although, with Supreme Court Justices, I'm not sure being dead is that big a sticking point. The Constitution doesn't explicitly say. And apparently, Justices don't have to be "natural born citizens" either. So, the fact that Karl Marx was German might not be a sticking point, either.

You want to see Republican heads explode? How about this? Michael Moore for Supreme Court! We can pretty sure corporate personhood would be on the chopping block.

Go ahead Kyl, you try to filibuster. I think even if we don't have the 60 Democrats needed to stop it that some principled Republicans will not stand for it. Susan Collins, Olympia Snowe, Lindsey Graham and John McCain were all part of the "Gang of 14" - and they are still serving as Republicans in the Senate. I think there may even be others who just have little taste for the filibuster.

We have 2-Republican Senators from Arizona, that couldn't find their way to the Mexican Border without a driver and/or a Spanish translator. Yet these 2-worthless assholes, spout their knowledge on illegal immigration, drugs, energy, etc., etc., etc. Arizona is the major crossing of drugs and our border towns have been facing serious drug wars both within and directly across our border with Mexico. Both innocent American and Mexican citizens are being caught in cross-fire of Mexican drug lords battles.

Arizona has the largest nuclear power plant in the US, just west of Phoenix which within the past few years has had a security breakdown.....with little report to the public. Solar along with wind energy could provide Arizona much of our energy, yet these 2-Republican Senators, have done nothing to support or encourage the technology/small business entrepreneurs struggling to open Arizona our Nation and the world to these badly needed energy systems which could provide work for thousands.

Arizonan's through John McCain's campaign for POTUS is suddenly awakening to the fact that although John McCain deserves honor for his POW status, this does not make him a qualified nor good representative for the peoples of Arizona. Kyl cannot even claim honor for military service and his actual knowledge of Arizona problems is even weaker than McCain's. Kyl is a blowhard and not even a good one, at that.

where they had a war for 500 years run by computers that simulated the action of war and simply spit out the names of the victims, who were then summoned and killed by their own side by agreement in order to avoid all the messiness and disruption and infrastructure destruction of an actual war.

with a real filibuster, you had to bring ALL senate business to a halt, and you had to get up there and let everyone know and see what you were doing. it was a risk: you could be seen as standing on principle or being an obstructionist, and so you did not filibuster lightly. nevermind the planning and stamina it required.

with today's gentleman's filibuster, it doesn't bring any senate business to a halt, it merely prevents the one vote; nor does it require any ongoing effort other than to vote to continue the filibuster when the question come up again. it basically means that there's very little that can get done by majority vote; any actual legislation requires 60 votes, and hence some republican cooperation.


meanwhile, when republicans had a bare majority, they ROLLED over the democrats by threatening to "go nuclear" and take away the filibuster entirely. as a result of this tactic, democrats were afraid to exert much power.

three guesses as to whether or not democrats will EVER threaten to take away the republicans' power of filibuster!

I can't believe any law maker would say something like this and believe he made any sense or knew a hill of beans about the law and our justice system.

Kyl said if Obama goes with empathetic judges who do not base their decisions on the rule of law and legal precedents but instead the factors in each case, he would try to block those picks via filibuster.

You have to look at the factors of each case, you have to review each case individually, and then apply the legal precedents as warranted.
