Siegelman and Scrushy to get another day in court

MONTGOMERY, AL (WSFA) - Forrmer Alabama governor Don Siegelman and former Health South CEO Richard Scrushy will have another day in court.

Oral arguments will be heard in an Atlanta courtroom before the 11th Circuit Court of Appeals on Tuesday, December 9th.

The two men claim the judge didn't give proper instructions to the jury and there was no proof of a "quid-pro-quo" which led to their 2006 convictions.

The court could throw out the convictions, let them stand or order a new trial. Siegelman is expected to appear, but Scrushy remains in a Texas prison.

1. I'm glad to see this.
I hope there's some media scrutiny on this. I don't trust the system down there. .

2. Anyword about whether or not rove will testify? I know that
Siegelman wanted him to do so under oath. I hope this Court Date will help Don Siegelman. Why on earth is Mr. Scrushy still in prison?

4. Rove's mentioned in this article, in reference to Siegelman:

Karl Rove's Executive Privilege May Vanish on January 20, 2009

~snip~
Rove may also be compelled to testify about other matters such as the vendetta against former Governor Donald Siegelman who spent jail time on what appear to be trumped up charges, about his role in the Valerie Plame matter and his practice of using non-Government email addresses to conduct business, just to name a few.

Rove may attempt to stall by invoking Executive Privilege himself. His argument would have to be that he, himself, relied upon the confidentiality of the conversations. He would also have to indicate that he did, or did not, talk to the President about these specific issues.

But, it should not matter. Executive Privilege belongs to the Office, and the assertion of "personal harm" is not germane. As with Bush and Janet Reno, the President at any given time determines what is considered harmful to the Office, and the President will be Barack Obama.

Nor will Rove's inevitable pardons rescue him. Indeed, they may facilitate getting his testimony since he will not be able to assert 5th Amendment rights.

3. Will Siegelman present info on the railroading he got from the Rove gang?
Or is this new trial a concession for the facts he already presented?

5. This is an appellate argument -- not a trial
If they win on appeal, they will get a new trial. There is the remote possibility that the Appellate Court will toss everything out but I doubt it.

6. Damn.
After everything we know about this case, I'm just surprised there isn't more of a move to expedite the legalities so we can get down to the real criminalities. What happened to Siegelman reminds me of something I read that was written by Kafka or, maybe it was Solzhenitsyn.

7. Relief may be coming soon
If he wins on appeal, that means the conviction is vacated and that a new trial would be required.
By that time, there will be a new U.S. Attorney for the district in place and he/she can decide to not prosecute any further.
