Skinhead charged in Obama plot wants dismissal

MEMPHIS, Tenn. – A white supremacist charged with plotting to kill President-elect Barack Obama and other black people wants his indictment dismissed, arguing that the federal grand jury that charged him had too many black members.

Twenty-year-old Daniel Cowart of rural West Tennessee and 18-year-old Paul Schlesselman of Helena-West Helena, Ark., face charges including threatening a presidential candidate and taking firearms across state lines to commit crimes.

Cowart's lawyer filed a petition Thursday seeking to have his client's indictment dismissed.
It argues that the 23-member grand jury that returned the indictment had just two white members and could not have been fair and impartial.

I'm not sure but in the photos at the link it looks like
the court appointed attorney is african american.

Attorney: Drug Lab was Student's Independent Research

JACKSON, Tenn. (AP) -- .... The Jackson Sun quoted attorney Joe Byrd as saying 22 year-old David Cook was conducting independent academic study and at least one professor knew about it.

The only charge filed last week was possession of drug paraphernalia and marijuana, to which Cook pleaded not guilty and was released on bond. Police said they were awaiting tests on chemicals taken from the apartment.

Capt. Barry Michael, commander of the Jackson-Madison County Metro Narcotics Unit, said notes and formulas police found indicate the lab might have been used to make illicit drugs.

Byrd said his client was doing medical research.

7. Well I have no problem agreeing that young David Cook was doing independent study testing the
effects of marijuana. But unless he can show that he had adequate controls, I would say that it cannot be considered to be "academic study" however. That's the bad news. The good news is that when he runs for political office we can all agree that because of his age it is just a youthful indescretion and he can truthfully say, "Yes I experimented with drugs as a youth." In some circles that might actually win votes so there could be a silver lining to this. Of course if the police decide the amounts found can justify a charge of "intent to destribute" things may not go so well for young David.

running a meth lab in your apartment does not count as "independent academic study" or "medical research" especially since you were doing your research under carefully supervised clinical party conditions.

It doesn't quite fall under the Federal Work-Study Program either.

LAS VEGAS, Nevada (CNN) -- A jury of nine women and three men -- none of them black -- was seated Thursday for the trial of O.J. Simpson on kidnapping and armed robbery charges.

The judge made no official mention of the jury's makeup, but prosecutors revealed in court that no blacks were on the jury. A black man and black woman, however, are among six alternate jurors.


I know it wasn't a grand jury and the juries are in two different states but just the same.

Defense attorneys had argued the prosecutors were deliberately trying to exclude blacks, but Judge Jackie Glass denied their challenges.


What's fair is fair and you can't have it both ways...
